The scheduled reporting system was designed to collect taxes in advance on the premise of a final report. As the basic nature of the scheduled report is to schedule a follow-up settlement process, the scheduled report itself cannot be considered conclusive given the purpose and purpose of the system itself. However, the concept of firmness arises not from the nature of the scheme, but from a series of procedures in which the obligation to pay is established and the obligation to pay is fixed.
First of all, the current law stipulates that the scheduled transfer income tax report can be exempted from the scheduled transfer income tax report, ending the tax obligation as a scheduled report. Second, specific tax standards and tax amounts are set as scheduled capital gains tax returns, and third, for non-compliance with the capital gains tax return obligation, the taxation authority exercises the right to impose and levy additional taxes on scheduled reports. Fourth, the tax base and tax amount can be changed through the revised or revised reporting process of the scheduled report itself.
By confirming this fact, it was confirmed that it was substantial to consider the expected declaration of capital gains tax to be conclusive. In this study, the scope of the scheduled report was summarized through the meaning of the term "legal mental limit" prescribed by the tax law, but it was confirmed that there were problems when applying the law because each law had different interpretations. However, it was confirmed that the scheduled transfer income tax report was not intended to be carried out from the purpose of the original scheduled reporting system and was required to fulfill the tax obligation equivalent to a fixed report.
However, it was concluded that the expected value-added tax report could not be determined, at least in the current legal framework, that there was a requirement to be settled on a fixed report and that additional taxes were excluded. It is clear that the scheduled reporting system contributes to the equalisation and stabilisation of tax revenue management by taxation in the near-term vicinity of income. However, the current law requires taxpayers to bear a level of obligation equivalent to a firm declaration of the expected transfer income tax, and recognizing the legal status corresponding to the degree of obligation to be borne is not confusing.
Consequently, a measure was proposed to establish a new regulation that would have the effect of finalising a transfer income tax report. It is worth noting that the main reason for the obligation to report capital gains tax is the need for settlement when applying the period tax rate when it comes to establishing a relationship between a firm report and a scheduled report. I think it is practical to resolve competition in legal status by interpreting that the final report of capital gains tax has practical meaning only when it is necessary to settle the scheduled report.
