등기청구권에 관한 소고

권리 이전과 거래 안전을 위한 등기청구권의 법리를 검토하였다.

The purpose of registration is to complete the transfer of right and to protect one’'s private property. So it serves to work for the good of the public and to keep the security of transaction. The problem is how to register specifically, and how to c1aim the registration. If we want to abridge the process of registration, it must be practiced by the third person’'s internal terms. It may cause a problem in business transaction. Registration must be considered as the act of real right. If not, it will cause a serious problem under the Civil Law in force. The curtailing of registration will be helpful in that it saves time and processing red tapes.

In this study, 1 closely examined the case and theory of registration.
