중국 해양지적(海籍)제도의 특징과 시사점

중국 해양지적제도의 법·제도·기술적 특징과 시사점을 분석했다.

The paper describes China's marine cadastre system including definition, management and characteristics based on laws and regulations. From the perspective of legal, institutional and technical view, China's marine cadastre system has improved since last 10years. First of all, in the field of legal system, China has basic law and also has equipped a set of rules and regulations regarding to marine cadastre. Secondly, China established marine cadastre center only for managing and operating marine cadastre this year. This centre will improve efficiency and immediacy of operating marine cadastre system in China.

Thirdly, China also has well organized marine cadastre management system in the technical area. China's marine cadastre management system includes marine cadastre investigation, registration, statistics and storage, and this comprehensive system implies somewhat to our introduction of marine cadastre system. 본 연구에서는 중국 해적제도에 대한 법체계와 법조문 중심으로 중국에서의 해양지적의 개념, 해양지적의 관리 및 운영체계, 그리고 그 특징을 살펴보았다. 중국의 해양지적제도를 법적·제도적·기술적 측면에서 종합적으로 판단해 보면, 첫째 법적 영역에서는 「중화인민공화국 해역사용관리법」이라는 기본법이 제정되어 있다는 점과 이 법을 근거로 다량의 부문규장과 지방성법규가 세트(set)를 이루며 비교적 해양지적에 필요한 여러 법규가 체계적으로 잘 완비되었다고 할 수 있다. 둘째 제도적 영역에서 볼 때, 해적관리처가 설립되기 전에는 해적관리를 전담하는 조직의 부재로 일관성이 부족하였다고 할 수 있겠지만, 해적관리처 설립 후에는 해양지적제도 운영의 효율성과 합리성을 기대할 수 있으리라 보인다.

셋째 기술적 측면에서는 「해적조사규범」을 근거로 해적조사와 해적측량을 보완하여 전문적이고 체계적인 해양지적관리시스템을 갖추고 있다고 볼 수 있다. 해적조사에서 해적등기, 해적통계, 해적등급 분리와 해적자료 보관까지를 아우르는 중국의 해적관리시스템 관련 법제와 기술은 우리나라의 해양지적제도 도입에 시사해주는 바가 크다.
