A project implementer under the Act on the Improvement of Urban Areas and Residential Environments (hereinafter, the "Urban Improvement Act") must obtain the actual possession of the land and buildings within an improvement zone before construction can begin.
The Act, however, does not squarely regulate the means and procedures for doing so. In practice, implementers rely on two private-law devices: the right to demand sale against non-consenting owners in reconstruction projects and a claim for delivery of buildings grounded in the effect of the authorization and public notice of the management and disposal plan. This article argues that neither device coheres with the public-law character of the Act.
First, the Act structures the entire project―from designating the improvement zone through the transfer notice―as a chain of administrative dispositions; however, private-law instruments are deployed precisely at the stage that determines the fate of the project. Second, Article 81(1) merely suspends the former right holder’s use and profit; it confers no title effective against third parties. Therefore, treating it as the basis of a proprietary claim for the return of possession is a strained construction.
Third, the right to demand saleis exercised on the ground of non-consent at the association-formation stage, before the substance of the project is fixed, and lacks any provision for livelihood compensation. Fourth, a delivery claim proceeds as a civil action, while compensation, such as housing relocation expenses, proceeds as public-law party litigation; therefore, the same issue is examined twice before different courts.
The article, therefore, proposes repealing Article 64,consolidating site acquisition into the parceling-out application procedure and the ensuing consultation on compensation, and expressly providing for landowners’ obligation to remove or relocate obstacles together with a statutory basis for administrative vicarious execution. Even accepting that an obligation to deliver is non-substitutable and, thus, outside the scope of vicarious execution, an improvement project ultimately seeks not the transfer of possession but the removal of structures. Recasting the obligation as one of "removal" instead of "delivery," thus, opens the path to vicarious execution.
The Supreme Court has held that, where removal may be carried out by vicarious execution, occupants may be evicted incidentally without a separate enforceable title; once the removal obligation is codified, today’s duplicated proceedings can be merged into a single public-law procedure.
