In these days, owing to economic growth and rapid industrial development the more real estate is transacted actively, and fluctuations of the property right being frequent, the need of confidence of the register as a means of public announcement on fluctuations of the real right in real estate is not recognized in the existing civil law, Because, in the case to admit public confidence, those who bought a real estate under a true belief which is registered on the register book can't be protected under a legal legislature. Therefore it is necessary to provide a detailed measures for accident to be happened afterwards and for the preventive policy.

Accordingly, in this thesis, I intend to provide preventive arrangements that can protect the security of transaction and the true owner of the right from the insolvent register. As a preventive measure, the principle of public announcement, the right of the practical examination by a register official clerk, specialization of the register institute, modernization of the land register system, etc., are necessary. As a measure for the post relief, the compensation system for damages and title insurance system must be adopted. Of course, our civil law does not recognize public confidence of the real estate register by now.

But we must recognize public confidence of the real estate register to protect the true right and take a proper measure for the post relief and the preventive arrangement, Putting stress upon this points again, I intend to come to a conclusion.
