Korea's concentration of population in cities is most serious next to such city states as Hong Kong and Singapore. Various surcharges and donation of land parcels for real estate development projects are transferred to the commercial building or housing prices only to push up their sales prices, while increasing developers' financial burden, discouraging investors and having the effects of dual taxation on the people.
Due to rapid economic growth and urbanization, population and industries are concentrated in the capital areas and metropolitan cities, and as a result, housing falls short in terms of quantity, while the demands for the industrial facilities required for the rapid economic growth and the basic facilities thereof continue to increase at a formidable speed. Such fast urbanization has resulted in various problems such as traffic congestion, housing shortage, reckless land development, rapid rise of land prices, and the like. All these problems cause various side-effects for nation's industries, and the fundamental cause for them may well be found in land use and development.
Meanwhile, disputes legal or administrative have been arising surrounding legality of the conditions for the real estate development surcharges. Hence, it is required of relevant authorities to rearrange the legal systems and administrative practices because the local autonomous administrations are, in lawsuits surrounding the disputes of real estate development surcharges, found responsible for proving for 1) reasonable estimation of surcharge, 2) clear sources which surcharges should be alloted to, 3) specially close relevancy and 4) objective adjacency. The surcharges related to real estates may be divided into those for financial revenues and those for policy goals.
In order to justify the former surcharges constitutionally, the following conditions are deemed to be fulfilled. First, any surcharge should be exceptional in its relation to tax. In other words, the law makers should not be given a discretion to decide whether a public project should be financed by tax or surcharge.
Second, the people obliged to pay surcharges should be 'specially closely related' with the development, compared with ordinary tax payers Third, considering such nature or exceptionality of surcharges and the possibility that surcharges may be abused as means of escaping from the democratic control of the National Assembly against executive branch's finance, the law makers are obliged to continue to assess validity and fairness of the surcharges if they should be levied over long time.
In contrast, the inducive surcharges or those for policy goals should be optimized to achieve their socio-political goals, and thus, they should not violate the principle of fair tax burden by ignoring the principle of equal taxations reflecting tax payers' ability. In addition, it is not that the correlation between surcharges and their socio-political goals should be clear but that should there exist a reasonable cause, the surcharges for some policy goals may well be justified exceptionally even if they should treat tax payers differentially.
Recently, such financial and inducive surcharges as redevelopment and reconstruction surcharges have added up to the real estate development surcharges, while some of the existing surcharges are being abolished. Such changes may well be interpreted to the effect that the government cannot take some pre-emptive counter-measures against the problems of the private economy evolving fast according to development of the democratic market economy but approaches the problems politically. As administrative demands are diversified, the special surcharges required to achieve special administrative goals are not well distinguished from tax.
Although real estate development surcharges may well be essential tools for diversified roles of the modern administration, the surcharges for financial revenues should be temporarily levied, and they should be replaced with other taxes the base of which have been developed, except for some inevitable cases.
