도시정비사업의 탈법행위 방지를 위한 제도적 개선 방향 연구

도시정비사업 관련 탈법행위의 유형과 제도 개선 방안을 분석했다.

도시정비사업은 조합을 중심으로 시공사, 정비업체 등 다양한 이해관계자가 얽혀있고, 고액의 공사비와 용역비가 집행되는 사업이다. 하지만 사업 특성상 여러 이해관계자 간의 정보 비대칭이 발생하며, 자금 집행에 대한 투명성 확보가 어렵기에 여러 탈법행위를 야기할 수 있는 제도적 취약성을 내포한다. 본 연구는 2014년부터 2023년까지의 도시정비사업 관련 형사 판례 695건을 전수 조사하고, 이 중 대법원까지 심리된 170건을 중심으로 주요 범죄 유형을 실증적으로 분석하였다. 특히 심급 간 판결의 변경 여부를 통해 형사적 확정성의 구조를 검토하고, 뇌물, 배임, 사기, 횡령 등 주요 탈법행위의 양태를 유형화하였다. 또한, 탈법행위의 유형을 피쉬본 모형으로 시각화하였으며, 조합 중심의 사업 구조에서 반복적으로 나타나는 제도적 취약성을 확인하였다. 이를 바탕으로 정보공개 강화, 반복 위반자에 대한 가중처벌, 계약절차의 투명성 확보 등 제도 개선 방향을 제시하였다. 본 연구는 도시정비사업에서 나타나는 탈법행위의 양상을 이해하기 위한 분석 시도이며, 제도 개선을 위한 후속 연구의 발판이 되기를 기대한다.

Urban redevelopment projects involve a complex network of stakeholders, including cooperative associations, contractors, and redevelopment service providers, with substantial construction and service costs at stake. However, due to the inherent characteristics of these projects, information asymmetries among stakeholders and the difficulty of ensuring transparency in fund execution create institutional vulnerabilities that can lead to various unlawful practices. This study conducts a comprehensive review of 695 criminal cases related to urban redevelopment projects from 2014 to 2023, focusing on 170 cases adjudicated by the Supreme Court, to empirically analyze the major types of crimes.

In particular, it examines the structure of criminal legal finality through changes in verdicts across court instances and categorizes the patterns of major unlawful acts, including bribery, breach of trust, fraud, and embezzlement. Furthermore, the study visualizes the types of unlawful acts using fishbone diagrams, confirming institutional weaknesses repeatedly observed in the cooperative-centered project structure. Based on these findings, it proposes directions for institutional improvement, such as strengthening information disclosure, imposing heavier penalties on repeat offenders, and ensuring transparency in contractual procedures.

This research is an attempt to understand the patterns of unlawful practices in urban redevelopment projects and aims to serve as a foundation for future studies on institutional improvements.
