The cadastral map of Korea is the most important basic information in today’s cadastral survey. It has been doing the role of public register representing the land ownership of people; however, it has been kept by cadastral map which was made 100 years ago. Accordingly, there are serious errors caused by the limitation of cadastral map drawings and the errors occurred by continuous revision of cadastral map, which had been made by obsolete survey technology in the past.
Today’s cadastral map includes coordinates; however, even today’s cadastral map has certain extent of error because of technical limitation and the limitation in manual method in obtaining the coordinates. Though surveying technology has advanced and new equipments have been developed, still there are human errors and mechanical errors which cannot be practically overcome which prevent accurate recovery of existing boundary point at site without error.
The purposes of this study are; removing the distrust of people on cadastral survey for areas where cadastral map and actual site condition do not agree with each other, minimizing unnecessary civil complaints on cadastral map and suggesting a rational determination method of cadastral boundary. In order to efficiently achieve the study purpose, the study object area was set up as the area in Gwang-jin District of Seoul Metropolis, where the cadastral map and actual site condition do not agree with each other. Control points were buried and site survey was done.
Then the past survey results were analyzed and three types of disagreement were drawn, which are; location move type, blank type and overlapping type. As last, the most optimum boundary determination method was drawn by comparison and analysis. Regarding the location move type; it is suggested to determine the result based on current actual status and past surveying result. Then it is recommended to move the coordinates of existing cadastral map by the result of control point like it is done during cadastral readjustment survey or scale change survey. By doing this, it is possible to organize the cadastral map without revising the boundary and area registered in existing cadastral map.
It is also possible to maintain the cadastral map by simply moving the coordinates in the cadastral map without civil complaints of land owners and not putting in additional manpower and time. Regarding the blank type, the revision of cadastral map would be different dependent on the form of occupation by blank part at site. If the blank part is being used by adjacent land, the cadastral map would be revised so that the adjacent land would show correct occupied part. If nobody is occupying the blank part, a new lot number would be given and it will be newly registered to the cadastral map.
If the blank part is being used by road or state owned land, it is recommended to newly register it to cadastral map and have government control it. The overlapping type is the most serious disagreement type in which it is not possible to recover the boundary and area in the cadastral map at site because of overlapping of survey results. The cadastral map should be revised and registered by having it agree with adjacent lands dependent on occupying status at site. Government should give practical compensation such as monetary compensation, tax reduction/exemption or relief of floor-area-ratio when there is a new construction.
The overlapping type is the most serious disagreement type which can be resolved only by active intervention of government. Both blank type and overlapping type are disagreement types which occur at boundary of survey results; however, there is no legal definition on the responsible principal for this disagreement type; therefore, land owners are suffering all resulting damages now. Government has the responsibility for the management of national land and only government can correct such disagreements; therefore, it is suggested that government take more active intervention for the resolution of those disagreements.
