초록
Article 61 of the Land Compensation Act requires the implementer of the project to compensate for losses incurred by individuals (landowners or related persons) due to the implementation of public projects by public institutions such as the state or local governments. In principle, compensation for losses should be paid in cash, except as otherwise expressly provided for in other laws. When land compensation is paid, the government has tried to revitalize cash alternative payment methods such as bond compensation and land compensation, as the side effects of reinvestment into nearby areas and rising land prices are issued.
However, bond compensation is difficult to cash in for a certain period of time and the yield is not high, so the ratio paid in bonds is not high because the inmates do not prefer it. Also, there is a problem with equity as absentee shareholders are supposed to be compensated with bonds. Some land compensation methods are compensated with land developed after public projects are carried out instead of cash, but this method was not activated because it is more advantageous to reinvest cash compensation in other real estate when land prices rise.
In response, the government is actively introducing alternative land compensation REITs, which can even earn development profits from public projects, to reduce the burden of raising land compensation and prevent further increases in surrounding real estate. This study seeks to examine the current status of land compensation payments in public projects and explore problems and alternatives according to the compensation method.
