해양등록부 창안에 관한 연구

해양의 공적 관리를 위한 표준 해양등록부의 설계 방향을 제시했다.

해양은 경제적ㆍ사회적ㆍ문화적 환경변화에 편승하여 그 어느 때보다도 이용 및 경제가치가 급부상하고 활용의 실익이 더욱 가중되어 공적 관리의 필요성이 증폭되고 있다. 따라서 본 연구의 목적은 해양관리를 위한 주체ㆍ등록객체 및 공부의 형식을 검토하여 향후 표준적이고 통일적인 해양등록부의 설계방향을 설정하는 것이다. 이러한 연구목적을 달성하기 위하여 연구범위는 해양등록부로 한정하였고, 조사방법은 문헌조사와 전문가 인터뷰를 통하여 수집하였으며, 접근방법은 서술적 접근방법과 현상학적 접근방법을 병용하였다. 연구결과는 다음과 같은 견지에서 도출하였다. 첫째, 해양관리의 일반성은 정의, 필요성 및 기능, 해양관리의 객체 및 형식차원에서 검토하였다. 둘째, 해양등록부의 운영실태 및 한계는 해양관리를 위한 법체계, 해양등록부의 관리주체ㆍ형식ㆍ객체의 실제, 해양등록부의 한계 차원에서 검토되었다. 셋째, 해양등록부의 설계방향은 지원방향설정, 해양권리등록부의 설계, 해양관리공부의 설계, 관련 공부와의 연계 차원에서 검토되었다.

Under getting a ride in economicㆍsocialㆍcultural environmental change, the necessity of public management to the marine is more amplified by increasing the actual profit of application and the use and economic value of marine rather in any time. For that reason, the purpose of this study is to set the standard and uniform design directions of marine public records in the future by examining the management subject, the registration object, and the registration forms in order to marine management.

To achieve the research objective, the research range was limited to the marine public records, a data through the reference of literature and an expert interview was collected as the research method, and a descriptive access method and a phenomenological access method was applied. The research findings are as follows; First, the general reasoning of marine management was reviewed in terms of definition, necessity and function, and object and forms for marine registration.

Second, the operating actual condition and the limits of marine public records was applied as a viewpoint of the law system for marine management, the subject and object of registration, and the forms of marine public records. Third, the directions for designing marine public records was referred to the establishment of support directions, the design of marine right register, the design of marine management books, and the connection of related records.
