공익사업을 위한 토지수용에 있어서 탐정의 역할 제고 방안

공익사업 토지수용 과정의 탐정 역할과 보상·분쟁 대응 방안을 연구한다.

지난 60년간 우리나라는 ‘한강의 기적’으로 불릴 만큼 경제적으로 비약적인 발전을 이루었으며, 1997년 IMF 구제금융 이후의 경제위기를 극복하고 세계 10위권에 근접하는 성장을 달성했다. 이 과정에서 계획적인 국토개발사업이 주요한 역할을 했으며, 특히 1980년대 이후 주거 안정과 복지 증진을 위한 정부의 정책이 추진되었다. 이러한 공익사업들은 토지수용을 통해 진행되었으나, 정당한 보상 문제로 인해 많은 사회적 갈등이 초래되었다. 토지수용은 공익사업 추진을 위해 토지소유주와의 원만한 협의가 가장 바람직하지만, 협의가 이루어지지 않는 경우 강제적으로 진행된다.「헌법」제23조에서는 공공필요에 의한 재산권의 수용ㆍ사용 또는 제한 등, 재산권 침해에 대해서는 정당한 보상을 지급하도록 규정하고 있지만, 실제 현장에서는 사업시행자와 토지소유주 간의 분쟁이 빈번하게 일어나고 있다. 사업시행자는 신속한 사업추진과 비용 절감을 위해 낮은 보상금을 제시하며, 토지소유주들은 현재 시세를 반영한 정당한 보상을 요구하면서 갈등이 발생하게 되는 것이다. 이러한 현실에서 효율적인 토지수용 절차와 갈등 해소를 위해 탐정의 역할이 요구된다. 탐정은 중립적이고 전문적인 입장에서 토지수용 과정을 조사하고 갈등을 조정할 수 있다. 현재 우리나라에서는 탐정업이 충분히 활용되지 못하고 있으나, 다른 OECD 국가들은 다양한 관리제도를 통해 탐정업을 활성화하고 있다.

따라서 본 연구는 토지수용제도의 운영실태와 외국 토지수용제도를 파악하여 공익사업에서 발생하는 부당행위 및 불법행위 사례를 분석하고, 이를 해결하기 위해 탐정을 활용하는 방안을 모색하였다. 토지수용과정에서 일어나는 불법 및 부당사례를 살펴보면, 첫째 사업시행자 측에서 협의보상 당시 현실적 이용 상황과 관련 법령을 검토하지 못하고 평가한 사례, 토지보상의 가격산정에 있어 표준지공시지가의 비교표준지를 부당하게 선정한 사례, 이전이 불가한 물건과 누락한 물건에 대하여 부당하게 보상한 사례가 있다. 둘째 소유자와 관계인 측에서 비닐하우스 및 건축물 내부에 불법시설 설치행위, 공익사업지구에 위장 전입하여 행하는 불법 거주행위 등이 문제된다. 이러한 부당행위와 불법행위는 국가재정의 낭비를 초래할 뿐 아니라, 국가정책의 불신과 국민의 갈등을 조장하고 있으므로 이에 대한 실효적인 대책 마련이 요구된다. 따라서 토지수용에 있어서 문제되는 주요 불법·부당사례를 살펴보고, 그 해결방안의 하나로 토지수용 전문탐정을 활용하는 방안과 구체적인 역할을 제시하였다. 또한, 이를 위하여 토지수용 전문탐정의 자격제 도입을 제도화 하고, 토지수용 전문탐정의 양성을 위한 방안으로 전문학위과정의 신설, 전문교육과정의 개설 등 교육제도의 체계 방안을 제안하였다.

Over the past 60 years, Korea has made rapid economic development, so it has been called the 'Miracle on the Han River,' and has overcome the economic crisis since the 1997 IMF bailout and achieved growth close to the top 10 in the world. Planned national land development projects played a major role in this process, and government policies were promoted to promote housing stability and welfare, especially after the 1980s. These public service projects were carried out through land expropriation, but due to the issue of fair compensation, many social conflicts arose.

Land expropriation is most desirable for smooth consultation with landowners for the promotion of public service projects, but if no consultation is reached, it is compulsory. Article 23 of the Constitution stipulates that fair compensation should be paid for infringement of property rights, such as the acceptance, use, or restriction of property rights due to public needs, but disputes between the project implementer and the landowner frequently occur in the actual field. Project implementers offer low compensation for rapid project promotion and cost reduction, and landowners demand fair compensation reflecting the current market price, causing conflicts.

In this reality, the role of a detective is required for efficient land expropriation procedures and conflict resolution. Detectives can investigate the land expropriation process and mediate conflicts from a neutral and professional standpoint. Currently, the detective business is not fully utilized in Korea, but other OECD countries are activating the detective business through various management systems. Therefore, this study analyzed the cases of unfair and illegal activities occurring in public utilities by grasping the operation status of the land expropriation system and the foreign land expropriation system, and sought to use detectives to solve them.

In the process of land expropriation, there are cases in which the project implementer evaluated the actual use situation and related laws at the time of consultation compensation, cases in which the comparative standard of the official land price was unfairly selected in calculating the price of land compensation, and cases in which the non-transferable and missing items were unfairly compensated. Second, there are problems with the installation of illegal facilities inside greenhouses and buildings and illegal residential activities conducted by camouflaging and transferring to public utility districts.

Since these unfair and illegal acts not only lead to waste of national finances but also to distrust national policy and conflict among the people, effective countermeasures are required. The use of specialized land expropriation detectives and specific roles were suggested as one of the solutions, and major illegal and unfair cases that are problematic in land expropriation were examined.

To this end, a systematic plan for the education system was proposed, such as the establishment of a specialized degree course and the establishment of a specialized curriculum, and the introduction of a specialized land expropriation detective system was proposed as a way to institutionalize the introduction of a qualification system for specialized land expropriation detectives.
