When a business owner sells new buildings, corporate entities are subject to corporate tax, while individual entrepreneurs are subject to income tax. All entrepreneurs should bear the same tax obligations, regardless of their business type.
However, businesses engaged in real estate sales face additional burdens, such as the preliminary reporting and payment obligation on capital gains from land sales, and they can not receive tax support such as early refunds, unlike businesses in other industries. This study reveals that corporate entities selling real estate only incur additional corporate tax on the transfer income from land, whereas individual entrepreneurs in real estate sales face significantly broader tax obligations compared to their corporate counterparts. Imposing a greater tax burden solely because the taxable property is real estate is inconsistent with the principle of tax equity.
Furthermore, if the scope of tax obligations differs based on the type of business entity, with individual entrepreneurs facing broader obligations than corporations, it contradicts the notion of fair taxation. Thus, the scope of tax obligations should be the same for all business entities handling the same taxable property. To address this issue, the study suggests that if tax obligations specific to real estate sales are defined, the scope of real estate sales in tax law must be clearly defined. However, current tax laws inadequately define business operations and, despite the Standard Industrial Classification of Korea, have not addressed these issues across various tax laws.
Moreover, using real estate sales registration to evade high transfer income tax rates undermines the purpose of these rates. Nevertheless, entrepreneurs who build and sell new buildings rarely engage in construction to avoid these high rates. Therefore, if it is challenging to reduce the tax obligations for all real estate business owners, at least the tax burden on individual entrepreneurs building and selling new buildings should be alleviated. To resolve these issues, the study proposes the following solutions: First, the definition of business should not rely on case law.
Instead, relevant tax laws should include a separate provision defining business, and the deleted provisions of the Income Tax Act concerning the definition of businesses should be restored. This would prevent reliance on the Korean Standard Industrial Classification for industry categorization. Detailed explanations that distinguish between real estate sales businesses and housing construction and sales businesses, as described in the Income Tax Act enforcement standards, should be incorporated into higher-level legislation to facilitate taxpayer understanding and compliance.
Second, the criteria for revenue recognition from deposit sales are not standardized among corporate accounting standards, K-IFRS, the Corporate Tax Act, and the Income Tax Act, leading to frequent disputes with tax authorities. To align with the global trend of unifying accounting standards and to enhance trust in accounting transparency internationally, it would be beneficial to adopt a single standard. Third, individual entrepreneurs engaged in real estate sales uniquely suffer from the adverse effects of applying certain capital gains necessary expense regulations or the pre-reporting and payment system for transfer income when calculating business income.
These provisions should be boldly eliminated or reduced. Fourth, a loss should be recognized as a legitimate deficit arising from business activities and should be deductible from future business income, justifying the existence of the system. Current regulations should be reviewed to ensure there are no excessively harsh discriminations against individual entrepreneurs in the real estate sales sector. The relevant tax laws should be amended to allow carryover loss deductions, even if different tax rates apply. Fifth, the early refund system under the Value-Added Tax Act, which is currently limited to depreciable assets, should be revised to broaden its scope.
The current tax laws have resulted in discrimination against businesses engaged in real estate sales. These laws should be amended to eliminate discriminatory provisions between businesses. Lastly, the exclusion regulations for comprehensive real estate tax resulting from large-scale sales projects should be r
