用途地域地區制의 發展方案에 關한 硏究

토지이용 규제와 관리 관점에서 용도지역지구제의 발전방안을 연구했다.

The responsibility of an efficient land use and management should not be taken for an individual but a state. In other words, the land should be used and managed systematically in a state level. Moreover the rapid urbanization and industrialization in 60s' and 70s' increased the demand of land, and it made the control of land inevitable. According to this, the city framing plan had been established between 1982 and 1986, and then the amendment ordinance of city planning law enforcement ordinance was promulgated in February, 1988. Its focus lays in the rearrangement of twelve zoning areas and the zoning system in city planning law has some problems like as follows.

1) The structural problem of separation between city planning law and building law should be corrected. 2) The zoning designating authority should be transferred or mandated to the chiefs of local authorities like as a provincial president, a mayor and a county head man to solve the problem that each zoning is not suitable for the real state of an area. 3) The rules of legal regulations should be diversified that zoning system may be applicated appropriately to the real state of each area. 4) The frequent use transformations that bring about land owners' disadvantage and various damages should be avoided.

After the fact considered that the current zoning system is so unelastic and plain that it can't he corresponded appropriately to the diverse actions of modern cities and the new development ways, a new zoning system is presented in this thesis. It is divided into a special use zoning and a mixed use zoning roughly. The former is a system suitable for the areas that the uses in development areas are diverse and whose preservation or development is not easy, as they are under the special development aspects.

These areas are given a special character different from that of the common law, The latter is a system suitable for the areas that don't show the rapid development aspects but a smallscale development is expected, as the functions are mixed one another and an overall development is not easy.
