The Corporate-typed REITs is an advanced realty financial system that raise a liquidity of the real estate, promote the securitization of the real estate. It provide the opportunities of real estate investment into general. It enables many people to invest in real estate and achieve a stable and high return. It is expected to make a great contribution to the development of the real estate investment market and reduce the growing gap between the rich and the poor, and finally facilitate the reconstruction of both the companies and the financial institutions. In Korea, the Corporate-typed REITs was introduced by ministry of construction and transportation in 1999.
In April 2001, finally enacted the real estate investment trusts law. Through enactment of this law, the government wanted to see the new investment mechanism jump-start the dormant domestic property market and help cash-strapped corporations sell off non-business purpose properties with ease. Presently, REITs come in two types - CR-REITs and ordinary REITs. A CR-REITs is just like a mutual fund for stock investment - a paper company that distributes almost all of its profits to investors in the form of a dividend. This "pass-through" of profits entitles it to exemption from income taxes.
Being a paper company, a CR-REIT has no standing staff and its management is entrusted to a specialized asset management company (AMC). In contrast, an ordinary REIT is established and managed by a real company with standing staff. Although it also distributes most of its earnings to investors, it is not entitled to tax benefits, which means its return ratio will be lower than that of a CR-REIT. During the last 16 months, however, the collective investment product has partly failed to establish itself as a viable mechanism for channeling retail investor's money into the real estate market.
Presently, "Corporate restructuring (CR)" REITs has launched successfully to record rates of public subscription at a double digit. In contrast, there is no an ordinay REITs that approved by ministry of construction and transportation until November 2002. This study cites three factors for the failure - the excessive requisite and regulation, the regulation of assets operation and regulations favoring "corporate restructuring (CR)" REITs against "ordinary" REITs.
Namely, while taxes on corporate, acquisition and registration are exempted for CR-REITs, ordinary REITs are only entitled to a 50 percent reduction in acquisition and registration taxes, and therefore offer less profit to investors. On this study, I proposed alternative suggestions as activation program for the corporate-typed REITs which can be located as the new product of investment, efficient financing system in the real estate market. In order to activate corporate-typed REITs , it must be taken necessary measures listed below. 1. The exempt of corporate tax on K-REITs under some conditions such as the the organization of assests, distribution of its earnings to the investor, 2.
Permission of spots investment and external loan. 3. Providing institutional investors with incentives for participation such as abolition of 'lock-up', relief listing(stock exchange) terms, especially the dispertion of stocks, 4. Relief of limitation on disposal of assets( the retained real estate) 5. Permission for project finacing (mortgage REITs) and expansion of the object of investment, namely expand the object of investment into ships, airplanes, heavy machinery similar to real estate. 6. Development of diverse index related to REITs for the construction of information infrastructure, 7. Development of expertise and rearing of experts.
