지적재조사사업계획의 신 모델에 관한 연구

지적재조사 사업계획의 문제점을 분석하고 새로운 계획 모델을 제안했다.

본 연구는 지적재조사사업계획의 문제점을 살펴 본 사업의 성공적인 수행을 위한 새로운 모델을 제시하는데 그 목적이 있다. 본 연구의 수행을 위하여 토지관련 전문인(교육분야, 공무원, 정부투자기관, 대한지적공사 직원, 부동산서비스업 종사자 등)을 중심으로 설문을 실시하였다. 지적재조사사업계획 및 지적재조사법(안)의 쟁점사항으로는 추진기구의 비체계성, 2차원 지적의 한계, 지목분류체계의 비효율성, 지적재조사법(안)과 타법률과의 충돌, 분쟁지 해결방안의 미비, 지방자치단체 재원부담율의 불합리 등으로 나타났다. 전문인들의 의식을 분석한 결과 다음과 같은 사항은 지적재조사사업계획에 반드시 첨부되어야 할 사항들이다. ① 현행 행정자치부의 조직체계 및 업무량을 고려하였을 때, 지적재조사사업을 전담하여 추진한 부서의 신설이 필요하며, ② 지적재조사사업계획서에 따른 2차윈 지적의 한계에서 탈피하여 그 범위를 지중까지 확대한 3차원 지적으로 확대함으로써 다목적 지적제도를 지향하여야 한다. ③ 효율적인 토지의 관리를 위하여 지적재조사사업 계획 및 지적재조사법(안)에서 제시하고 있는 34개의 지목체계에 대하여 지중으로 확대되어 가는 토지이용현황을 반영하여 ‘입체지목’을 도입하는 방안에 대해서도 적극 검토해 보아야 힐 것이다. ④ 지적재조사법(안)과 기타의 토지공법들과의 관계가 명확히 정립되어야 할 것이다.

⑤ 이웃과의 경계분쟁이 발생하였을 경우 독일에서 사용하고 있는 “경계확정계약”의 도입에 대한 충분한 검토가 이루어져야 할 것이며, ⑥ 지방자치단체의 재정능력을 충분히 고려하여 사업소요경비에 대한 부담률을 조정하여야 할 것이다. This study aims to present a new model of cadastral reform in order to carry it out successfully by examining the current cadastral reform act(draft). To settle six problems, questionnaire of experts on the cadastre are made up and, then, are analyzed. On the basis of the above analysis, new model of cadastral reform project must include the following.

① It is crucial to establish the exclusive post of executing cadastral roferm project, ② The cadastral reform project are enlarged to three-dimensional cadastre, as well as two-dimensional cadastre, ③ It is essential to reclassify the land category to manage land effectively, ④ It is necessary to clear up the relation between cadastral reform act and the other land-related laws, ⑤ It is needed to introduce contact of the adjacent neighbors for settling boundary troubles, ⑥ The financial burden of a local autonomous entity was mediated reasonably in considering their financial independence ability.
