지적측량에서의 공익서비스의무 적용 가능성에 관한 연구

지적측량에 공익서비스의무를 적용하는 방안과 보상 방식을 검토했다.

본 연구는 지적측량분야에서 공익서비스의무(PSO)의 적용 가능성에 대하여 살펴보았다. PSO를 적용하기 위하여 먼저, PSO 적용을 위하여 가장 필요한 조건인 지적측량의 공공성과 공익성에 대해서 살펴보았다. 그리고 PSO의 개념적 고찰을 통하여 지적측량분야에서의 도입 필요성과 보상의 범위·방식·절차 등을 살펴보았다. 지적측량업무는 공공성과 공익성을 충족시키는 업무이며, 자원분배의 형평성과 효율성 측면에서 필요하다. 그리고 보상의 범위는 사업적 이익을 달성하기 위한 실비측면과 공익적 차원에서의 수수료 감면에 따른 손실보상이다. 보상의 방식은 정부의 재정보조 방식이 가장 적합하나, 정부의 재정지출을 수반하지 않는 경쟁사업자 보조방식도 고려할 수 있다. 또한 보상의 절차는 일반적인 PSO 보상절차에 따라 제안하였다. 지금 당장은 그러한 현상이 발생하지는 않겠지만 향후 지적측량업무의 개방이 가속화되어 손실이 발생하기 이전에 지금부터 지적측량분야에서도 PSO 도입에 관한 논의를 시작할 필요가 있다. The main purpose of this investigation is to closely examine the application validity on the public service obligation (PSO) in the field of Cadastral Surveying.

First of all, both preconditions, such as public concern of cadastral survey and public benefit should be considered as the prerequisite to be applied PSO. Though conceptual study of PSO, some practicalities like and introduce necessary and the range, method and procedure compensation have contemplated. Cadastral survey should be carried out with the purpose of obvious public interest, and also, be based on the equity and efficiency in resource allocation. The compensation consists of two different compensations such as the actual expense and loss.

With regards to the method for compensation, even though the financial assistance from central administration is the most suitable, the auxiliary system competitive service operators can be fully considered. Moreover, the procedure of compensation has been suggested through compensation procedure of the normal PSO. There is no necessary to consider occurrence of this phenomena for the present. However, since the market for cadastral survey open to public, it must be carefully considered.
