도시관리계획 경미한 사항 변경절차의 개선방안 : 도시계획시설 행정소송 사례를 중심으로

도시관리계획의 경미한 변경절차 개선방안을 소송사례로 검토했다.

본 연구는 도시관리계획 중 경미한 사항 변경절차의 개선방안을 모색하기 위해 도시계획시설 관련 행정소송 사례를 분석하고 전문가 의견조사를 실시하였다. 행정소송 판례 분석, 전문가 설문조사 결과, 도시계획시설 유형별로 교통시설, 환경기초시설, 공공문화체육시설 순으로 세부시설 변경 시 중요도가 높게 나타났다. 또한 개별 시설별로 중요도 차이가 확인되어, 시설 특성에 따라 차등화된 변경절차 도입의 필요성을 시사하였다. 연구 결과를 바탕으로 개별 시설별 중요도를 반영한 세부 기준 마련, 중요도가 높은 도시계획시설의 경미한 사항 제외, 전문가 검토 절차 강화 등의 제도 개선방안을 제안하였다. This study analyzed cases of administrative litigation related to urban planning facilities and conducted a survey of expert opinions in order to find ways to improve procedures for minor changes in urban management plans.

Analysis of administrative litigation precedents and expert survey results showed that the importance of changing detailed facilities was high in the order of transportation facilities, basic environmental facilities, and public cultural and sports facilities by type of urban planning facility. In addition, differences in importance were confirmed for each individual facility, suggesting the need to introduce differentiated change procedures according to facility characteristics.

Based on the research results, we proposed measures to improve the system, such as establishing detailed standards that reflect the importance of each individual facility, excluding minor matters for urban planning facilities of high importance, and strengthening the expert review process.
