The process of achieving land(site) is the best politicized when the government carry out development projects. Achieving land(site) is the first key to conduct development projects successfully in that development projects demand a huge land. In these modern times, achieving land(site) for development projects is highlighted due to rising interaction among the stakeholders resulting from diversified society and complicated interests. Namely, claimants of land compensation interact through diverse channel and assert their right by taking organized actions, which make process of achieving land(site) more costly and complicated.
On the basis of previous recognition, this paper aims to analyzes the process of achieving land(site) in aspect of network governance and suggests several alternatives to form Network Governance that is desi rable to achieve land efficiently. To do these things, this paper conducts case study of Munjeong Legal Town applying Institutional Analysis and Development Framework(IAD framework). The main features of Network Governance in the Munjeong Legal Town case are summarized as below. First, there is a noticeable one-way interaction between the claimants of land compensation and the relevant authority because of the regulation and attributes of community.
Especially, because business contractor is supposed to handle with the whole process of achieving land(site) issue, there was no link between the relevant authority and the claimants of land compensation. Second, the link between business contractor and the claimants of land compensation, both side of whom are the interested parties in the process of achieving land(site), was the strongest. Furthermore, the claimants of land compensation, who are not professional, make a contract with a relevant law firm and the law firm came into play in the network.
Third, although most of the subjects in the network are officially linked, the claimants of land compensation and the relevant authority are non-officially linked each other. This is because the claimants of land compensation normally communicate with the relevant authority in a manner of non-official channel. Third, although most of the subjects in the network are officially linked, the claimants of land compensation and the relevant authority are non-officially linked each other. This is because the claimants of land compensation normally communicate with the relevant authority in a manner of non-official channel.
According to the analysis, network among the stakeholers didn't work properly, which caused a lot of conflicts and disputes in the case. In order to address such problems, this paper systematized the structure of network governance into three steps so that network governance play a desirable role in the process of obtaining land. First step is a network among claimants of land compensation. This network is formed at first between claimants of land compensation. To form this network, this paper suggests an alternative that a local council initially arbitrate in a dispute among claimants of land compensation.
Second step is a network between business contractor and the claimants of land compensation. This network is fundamental part in the process of consultation for achieving land(site). Thus, it is need to be presented concrete alternatives. The alternatives this paper suggests are about reinforcement of regulations governing compensation meeting. Third step is a neutral authority-centric network. It is formed finally when the expropriation is decided. To make this network work properly, this paper presents constructing information provider system that make Land Commission trustworthy and reinforcing independence of Land Commission as alternatives. But this paper has its limitation.
To put it concretely, it doesn't present a new model reflecting typology of Network Governance in the process of achieving land(site). Thus, the typology of Network Governance need to be studied in the future research.
