North Korea, after entering into the co-operation agreement with People’s Republic of China in 2010 for co-management and co-development of Rason Economic Trade Zone (hereinafter “RETZ”), has actively engaged in developing land and implementing regulations and policies in regards thereto. In 2014, North Korea has enacted Regulations on Real Estate in the Rason Economic Trade Zone (hereinafter “Regulations”).
This study aims for a comparative study of the Regulations with Real Estate System in China, as well as the Real Estate Regulations for the Kaesong Industrial Complex and the Law of the Democratic People’s Republic of Korea on the Leasing of Land (hereinafter “Land Lease Law”) and provide recommendations for improvement. The Regulations is a progress compared to the Land Lease Law in several aspects in, inter alia, following aspects: it reinforces the land usage rights, provides for more in-depth regulations on real estate registration, allows for more freedom in real estate mortgage, and provides for implementation of mortgage through court.
However, several provisions that appear to be obstacles to investment and revitalization of the zone still remain. The problematic provisions stipulate that: transfer of land requires approval from registration authority, lack of land use may result in cancellation of usage rights, and appurtenances will be gratuitously returned upon termination of the lease period. The development and enactment of the above law is closely related to principal actors in the development of the RETZ, and its geological characteristics. North Korea is developing the RETZ with China, and two nations are cooperating in implementing policies and laws for real estate.
North Korean’s wish for reinvigoration of the zone, coupled with China’s influence, has seemingly resulted in a progressive land regulations improving upon the current Land Lease Law. However, North Korea’s open-door policy for the RETZ has not reached the level of that of China. The fact that North Korean companies and people are residing within the RETZ may be a factor in pulling back from a more drastic open-door policy. Also, RETZ is open to not only China but other nations, and especially Russia is wary of Far East Region leaning too close to China.
North Korea is also careful of the risk that may arise if RETZ, a strategic region for North Korea, becomes too dependant upon China for development and management. Thus, it is assumed that for real estate policy, a key factor for RETZ development, North Korea is not completely accommodating China’s demands. With the above findings, we believe that real estate regulations for RETZ is different from Real Estate Regulations for Kaesong Industrial Complex which has been used almost exclusively for South Korean companies, and is being developed in limited and gradual manner, building upon Land Lease Law and influenced by China’s real estate policies.
However, - despite North Korea’s expectations - if diversification of investment in RETZ is not successful, real estate policy for the zone will likely lean towards China. It is hoped that South Korea actively participates in the RETZ investment, thereby playing a key role in its development and working together towards progress of North Korean real estate policy.
