Farmland is the basis of the people's food supply and the preservation of the national environment, and is a valuable and limited resource that affects the development of agriculture and the national economy. Therefore, it must be carefully preserved and managed appropriately for public welfare, and at the same time, it must be owned and used in the direction of increasing productivity. However, the decline in agricultural income, the aging of rural areas, and the widening gap between provinces and farms.
Recent changes in the agricultural environment, such as a decrease in cultivated area and unstable food security, make it more difficult to manage farmland that respects the ideology of farmland. Since 1990, Korea has been actively implementing farmland management systems such as farmland trading business, farmland rental business, farm management rehabilitation support business, farmland purchase stockpile business, and farmland pension business through the “farmland bank” of the Korea Rural Community Corporation. Nevertheless, considering that farmland speculation such as the L.H.
crisis is still taking place, there seems to be a limitation in the role of the Farmland Bank as a farmland management organization. The purpose of this study is to examine the limitations of farmland banks and to suggest improvement measures. To this end, as of 1994, when the Farmland Act was enacted, the'temporal range' of the study was set and the history of the change in the farmland system was reviewed.
In addition, in order to examine the current status of the farmland bank, which is the'contents range', the role and function of the farmland bank and the performance of the project were analyzed by reviewing the farmland banking system and major statistics for agricultural, forestry, and livestock food. In addition, in order to explore the future development direction of the farmland bank, the farmland systems of Germany, France, and Switzerland, which are evaluated as European agricultural advanced countries, were compared and analyzed.
As a result of examining the farmland systems of the three countries, we were able to derive four common characteristics compared to the farmland banking system in Korea. First, it is to realize the principle of trans-freedom in the modern sense. In the modern sense, the principle of light free ownership means that non-farmers can recognize farmland ownership, but control leases so that practical farmers can manage farmland. Second, there is a comprehensive farmland management organization. All three countries have independent roles and scope of farmland management organizations or farmland systems.
By granting a preemptive right or a senior lease right to the farmland management organization, it fundamentally eradicates farmland speculation and stabilizes farmland trade and rural areas. Third, it is the active protection of farmland tenants. All three countries actively protect tenant farmers in order to preserve the value of efficient use of farmland. Fourth, it is the settlement of disputes related to farmland. Since farmland and agriculture have characteristics different from other real estate, the three countries resolve farmland disputes through an organization dedicated to disputes related to farmland.
By comprehensively reviewing the changes of farmland laws, the current status of farmland banks, and examples of farmland systems in developed countries, the limitations and improvement measures of farmland banks could be considered as four major. First, it is the expansion of farmland transactions through the farmland banking business. Second, it is the establishment of a virtuous cycle system for the farmland banking business. Third, it is the strengthening of support conditions for each project that has been realized. Fourth, it is to establish the leading role of the farmland bank as a comprehensive farmland management organization.
