일본 지적조사의 최근 동향에 관한 소고

일본 지적조사의 추진 현황과 제도적 시사점을 살폈다.

본 연구는 최근 본격화되고 있는 지적재조사사업의 추진 배경과 관련하여, 약 60여 년 간 지적조사를 추진하고 있는 일본의 사례에서 도출되는 주요 이슈를 검토하고 그 시사점을 파악함으로써 향후 추진될 지적재조사사업의 실효성을 확보하는 데 목적이 있다. 이상과 같은 연구의 목적을 효율적으로 달성하기 위해 연구의 대상을 일본 지적조사사업으로 한정하였고, 그 범위로서 시간적 범위는 일본의 지적조사가 시작된 1951년부터 현재까지로, 공간적 범위는 일본으로, 내용적 범위는 일본 지적조사의 추진에 따른 주된 현안과 우리에게 주는 시사점을 도출하는 것으로 구체화하였다. 연구방법으로는 일본 국토조사법 등의 적용에 기초한 법률적 접근방법을 사용하였고, 조사방법은 문헌조사법, 사례조사법, 인터넷조사법을 병행하였으며, 분석방법은 통계자료에 대한 기술적(記述的) 분석방법을 동원하였다. 연구결과, 본 연구는 일본 지적조사의 진척을 저해하는 결정적 요인으로서 필계미정지 문제를 핵심으로, 그것이 우리에게 시사해 주는 내용, 즉 향후 우리나라 지적재조사사업의 추진 시 필연적으로 거쳐야 할 토지소유자 간의 경계확정 과정에서 당해 문제가 원만히 해결될 수 있는 법 기술적 대안을 도출하였다. Lately, the hot issues of Cadastral Resurvey Project has been renewed in Korea.

Against the backdrop of this, we intended to guarantee the effectiveness of the project by reviewing the Japanese cadastral survey project which has been carried out for 60's years and by receiving uggestions from it. To achieve the purpose of study effectively, we limited the object of study to Japanese cadastral survey project. The scope of time was from 1951, which the project has began up to present. And also, the range of contents was concretely focused on the main issues, occurred in process of the Japanese project. With regard to the methodology of study, we firstly investigated legal principles of issues by annotating the National Land Survey Law in Japan and judicial precedents.

Then, we described the core of a topic for discussion in details. This study concluded that the decisive reason why Japanese project has not yet completed is due to the land parcel of non-fixed boundary. And also it will be the key to the Korean Cadastral Resurvey Project. Therefore, this study presented the ways how to establish alternative plan before the project begins in order to resolve many problems from it.
