Under the National Land Planning and Utilization Act, the district unit plan constitutes an urban planning instrument that comprehensively regulates the building use, scale, and appearance of buildings. Nevertheless, both academia and planning practice have largely concentrated on regulations governing building use and scale because of their direct connection with development projects.
By contrast, provisions relating to the external appearance of buildings—including their layout, form, and colour—have generally been treated as ancillary matters, with little attention paid to their conceptual basis or their character in public law. This article conceptualises the regulation of building layout, form, and colour within district unit plans as a distinct doctrinal category, referred to as appearance regulation, and examines its legal character from a public law perspective. To this end, it first defines the concept and scope of appearance regulation within the regulatory framework of district unit plans and considers its relationship with the concept of urban design.
It then analyses its objectives, public interest justifications, and legal foundations before systematically examining the content and functions of regulations governing building layout, form, and colour. The study demonstrates that appearance regulation is not merely concerned with the visual appearance of individual buildings or the enhancement of urban aesthetics. Rather, it serves as a comprehensive planning mechanism that mediates between architectural planning and urban planning in shaping urban space.
It further argues that appearance regulation pursues not only the improvement of urban amenity but also the public interests of promoting the efficient use of land and preventing risks associated with the built environment. This study contributes to the literature by establishing appearance regulation as an autonomous concept in public law and by clarifying its legal character within the district unit planning system. It argues that such regulation should not be regarded as a peripheral control over architectural appearance but as a fundamental regulatory domain that bridges the institutional gap between architectural planning and urban planning while shaping cities.
Conceptualising appearance regulation as an independent public law category also provides a coherent analytical framework for understanding the diverse regulatory functions performed by district unit plans.
