Our life requires three essentials of clothes, food, and housing, which last refers to real estate. As a crucial basis of our life and source of income, realty constitutes an important factor closely related to the quality of life. At the same time, it is an essential element that composes a nation, so it is not easy to define the asset value of real estate in one single word. In capitalist economy, real estate as goods is involved in endless flux according to the mechanics of demand and supply. In today’s world, with its explosive population growth, urbanization, liberalization, and globalization accelerate, thus increasing interest in and demand for real estate.
As a result, as what facilitates real estate transactions, a real estate agent’s job should get greater significance and value, and the same is true of the function and role of an agent who is charged with general affairs related to real estate transactions. Yet, it is undeniable in Korea that consumer perception is not established with regard to the real estate agent’s business and licensed real estate agents. Real estate agent business in Korea dates back to Gaekju geogan gyuchik (‘Rule on Business Brokerage’) of 1890 which was the beginning of the legislation on the real estate agent business.
It developed into Sogae yeongeop chwije gyuchik (‘Rule on Brokering Business’), which was enacted in 1922 as Decree No. 10 of Gyeonggi Province under the Japanese Colonial Government in Korea during the period of Japanese Occupation. Following the National Liberation, Brokering Business Act was enacted in 1961, and discussions of revision of Brokering Business Act began in 1975 and lasted for eight years until in 1983, the existing Brokering Business Act was abolished and Real Estate Agent Business Act was enacted.
And in 2005, with the total revision of Real Estate Agent Business Act, the title of the law was changed to Act on the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions. The purpose of the enactment of Act on the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions was to establish transparency and fairness in real estate transaction by stipulating the obligation of a real estate agent to report actual trade value of a real estate.
Specifically, it was an institutional device intended to prohibit creation of double copies of a contract, then a cause of real estate speculation and tax evasion, and thereby ensure taxation based on actual trade value. Through the past fourteen revisions of Act on the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions, there have been controversies involving many issues such as the title of the law, real estate transaction report system, real estate agent fee, Licensed Real Estate Agent Exam, excessive supply of Licensed Real Estate Agents, and perfunctory work training, while improvements have steadily been suggested.
Today’s real estate value is shifting its focus from preservation value to use value, with the real estate market expanding and reorganizing toward creation and maximization of newer and greater use values. However, current real estate market and real estate agent business have too many autogenic limitations to ably respond to such environmental changes.
In order to adjust to the real estate agent business environment that changes with industrial advancement, liberalization, and globalization and thereby secure appropriate viability, we have to address other problems in addition to the above-mentioned issues related to Act on the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions. For example, it is necessary to upgrade the professionalism and public trust related to licensed real estate agents, improve their services, and expand their operational areas by revising Act on the Business Affairs of Licensed Real Estate Agents and Report of
