不動産投機抑制政策에 관한 硏究 : 土地公槪念法制를 中心으로

토지공개념 법제를 중심으로 부동산 투기 억제정책을 연구한다.

Because of some bed phonomens, happened during the last few years, like the limited land, maldistribution of wealth, enomorous unearned income, the gulf between rich and poor, and speculation in real estate, Korean society is now seriously in a state of unstablity. Now we can find out its seriousness through the fact that the words of "the concept of public land" had got the absolute support of the people. And legimitive bills, evaluated as almost a revolutionary package, was passed in the National Assembly after having gone into many disputes.

There are many diverse prospectives relating with the new system of "the concept of public land", which partly carried out since 1990, and especially will be put in force from second half of this year. While some people say that it will not help rolving the land troubles if it's content is poor such as present, but others show systematic resistance against its increasing burdens of tax. The maintaining class of land especially has tried to lessening the strength of the law, taking advantage of various logics.

When we survey the srteam of land policies, however, it is sure that there was no consistence in operating land-related laws, and basic conditions like informations for applying them were lacking, so that the past policies could not do good work In this thesis, therefore, I limit the analyzing period from 1980 to the end of 1991 in order to be able to encounter positively with the problems according to the present condition of the speculation in real estate and the change of land policy.

First of all, I will effectively analyze the practicing problems and systematic defects concerning with the legimitive system of "the concept of public land", that is, the upper-limit system of possessing housing sites, the ret recess ing system of development profits, the profits taxation system for excess land, and intergrated land tax system, all of which are expended and put into operation from 1990. Then 1 will propose some reforming measures of anti-speculation policies. And at last, I will survey approaching theories related with this thesis.
