부동산등기제도의 문제점과 개선방안

부동산등기제도의 문제점을 분석하고 제도 개선 방안을 제시했다.

不動産은 인간의 사회적 경제적 욕망을 충족시켜주는 유형. 무형의 수단으로서 재산 중 가장 중요한 재화로서의 기능을 하고 있을 뿐만 아니라 오늘날 개인과 기업의 사회적, 경제적 생활에 있어서 필요 불가결한 중요한 의미를 지니고 있다. 不動産 登記制度는 등기라는 특수한 방법에 의한 不動産 물권의 공시제도이다. 不動産 登記는 不動産에 관한 일정한 사항, 특히 不動産 物權에 관한 사항을 등기부에 적어서 不動産의 현황과 물권관계를 공시함으로써, 不動産에 관한 거래를 하는 자가 뜻하지 않는 손해를 입지 않도록 하고, 나아가서는 거래의 안전과 신속을 꾀하려는 중요한 기능을 하는 공시제도이다. 그러나 등기제도의 미비로 인해 여러 가지 부실등기의 문제가 발생할 뿐만 아니라 그 폐해도 심각하다고 아니할 수 없다. 이와 같이 거래의 안전이 현저하게 위협 받고 있는 것에 대한 선량한 당사자의 보호라는 등기제도의 거래의 이상과 신뢰가 근본적으로 흔들려 등기제도에 대한 개선과 보완의 필요성이 가중되고 있는 것이 현실이다. 본 논문은 현행제도의 문제점과 개선안을 중심으로 외국의 등기제도와 우리의 등기제도를 심도 있게 비교 분석하고 기존문헌과 판례를 참조하여 이론적 체계를 수립하고 우리제도의 이상적인 개선방안을 도출해 보고자 한다.

The real-estate has a important significance of the essence to Social and economical life of individual and enterprise recently as well as it. functions as the most important property with existence and/or nonexistence typed method in order to satisfy human's social economical desire. The system of real estate registration is that of public. notification of the real right of a reaal estate by a special method named the registration.

The real-estate registration is purpose in order not to be taken an unexpected damage for the real-estate transaction by public noticing the real-estate condition and relation of its real right to be record on the register book for a certain matter of real-estate, especially for the real right of real-estate. Furthermore, it is system of public notification to be significantly functional so as to promote safety and speed for a transaction of the real-estate. But, Not only the problems of various false entries occur due to an institutional inertia of registraion but also its damage is very serious.

Thereafter, it is reality to increase the need of improvement and complement for the registration system because the original purport and confidence of the registration system so as to protect for the good person concerned is basically shaken because of a striking threat to the safety of transaction. This thesis is to find out the improvement device of our system to establish a body of theory to make reference to an existing literature and a precedent case, to compare and analyze the difference between the system of foreign registration and that of our foreign registration deeply by dealing with the problems and improvement of the present system mainly.
