This study analyzes the current farmland law system and proposes directions for its improvement, in recognition of the fact that the existing legislation does not adequately respond to the pressing realities brought about by the decline and aging of the rural population, which have made the maintenance and management of rural resources increasingly difficult and have accelerated rural depopulation. This study first examines the historical development of Korea's farmland law system and, through comparison with Japan's farmland law system, identifies problems in the current systems of farmland ownership, use, and management, and proposes directions for improvement.
First, the current farmland acquisition certification system functions merely as a formal requirement with limited practical effectiveness. Moreover, substantive review under this system is virtually impossible, and thus, it should be abolished to enable greater freedom in farmland acquisition. At the same time, this study suggests that farmland preservation can be adequately ensured through the strict regulation of farmland conversion permits. Second, the existing Farmland Act does not contain explicit prohibitions on foreign ownership of farmland.
Foreign purchasers are only required to undergo a review process by the Farmland Management Committee in order to obtain a farmland acquisition certificate. However, they may acquire farmland without restriction if the land is exempt from this requirement. In response, this study suggests that foreign ownership of farmland should be prohibited due to the limited land area and the critical role of agriculture in ensuring national sustainability.
Third, current provisions in the Farmland Act limit ownership of inherited farmland but are largely ineffective when the excess farmland is entrusted to the Korea Rural Community Corporation, since ownership limits do not apply during the trust period. Furthermore, the sale of inherited farmland exceeding the ownership limit may lead to further fractionation; thus, the abolition of the inherited farmland ownership limit regulation is proposed. To solve this, the study proposes mandatory reporting and penalties like those stipulated in Japan's Farmland Act.
Fourth, the Korea Rural Community Corporation does not buy farmland under shared ownership, and it is challenging to trade inherited co-ownership shares. In order to facilitate transactions involving co-owned farmland, this study proposes establishing a quasi-public farmland share trading system. Fifth, while fostering large-scale corporate farms is essential, the reality is that there are difficulties in corporations entering into agriculture due to the characteristics of agricultural investment and the opposition of farmers' organizations to companies seeking to enter the agricultural sector.
Despite these challenges, promoting such farms remains crucial for addressing rural population decline, an aging farming population, and diminished agricultural competitiveness. This study proposes measures to ensure that corporate involvement in agriculture generates positive economic outcomes for individual farmers. Sixth, this study demonstrates that government efforts are needed to liberalize farmland lease arrangements in order to foster corporate farms, while at the same time establishing clear regulations regarding lease terms, rental rates, and other aspects of lease conditions.
Seventh, the Farmland Management Committee system, reinstated in the 2021 amendment to the Farmland Act, unnecessarily complicates the farmland acquisition procedure and provides only limited review authority, therefore discouraging farmland transactions. The study argues for its elimination and suggests that tighter post-acquisition control, such as charges for compelling performance and limitations on farmland conversion permits, can more effectively prevent speculation.
Finally, the study suggests that to address the problems of sprawling development and fractionation of farmland caused by the simplified conversion permit procedure for farmland smaller than 3,000 square meters within agricultural development regions, it is necessary to strengthen the residency requirements in these zones, set the conditions for delegating authority to the Minister of Agriculture, Food and Rural Affairs based on substantive criteria rather
