토지공개념의 제도사적 고찰: 토지제도의 변이와 토지공개념의 도입과정을 중심으로

토지제도의 변화와 토지공개념의 도입 과정을 고찰했다.

According to the recent trend of public concept of land ownership, it is formulated in form of maximizing the distinct characteristics and public interest while not going against the previous fundamental idea of social and economic structures. The social recognition regarding the needs to introduce the public concept of land ownership continuously presents a possibility of postponing its application under the circumstances that it is implemented limitedly through the institutional transition for several times. However, the introduction of public concept of land ownership for realizing land justice should be emphasized continuously as a policy project.

The purpose of this study is to provide analytic grounds for creating the future-oriented concept of public concept of land ownership through the analysis of public concept of land ownership from an institutional history perspective. The idea of land and land-related systems that formed the foundation for main land system for each period were set as the main analysis target. The public concept of land ownership is discussed based on the ownership of land, and the transition in the public concept of land ownership can be understood clearly through understanding of relation of land ownership for each period and the transition process of other political attempts.

The institutional history analysis using the methodology of new institutionalism has an advantage to explain the time series process of land system under the principle of state ownership of land based on traditional idea of royal domain being restructured into the modern public concept of land ownership.

Considering the fact that most precedent studies related to the public concept of land ownership were carried out based on the direction of legal interpretation and regulations from public land law perspective, it is expected that the characteristics of transition in the system for each period can be identified through institutional history consideration of public concept of land ownership in this study. 토지공개념 도입의 필요성과 관련된 사회적 인식은 몇 차례 제도 변이(variation)를 통해 제한적인 시행이 이루어지고 있는 상황에서도, 제도 적용의 연기 가능성이 꾸준히 제기되고 있다. 이는 토지공개념에 대한 시각의 차이를 극복하지 못하고 있기 때문이다. 토지공개념에 관한 최근 경향은 특수성과 공익성을 극대화하되, 기존의 사회 및 경제체제의 기반 이념에 반하지 않는 형태로 구상되고 있다. 향후 토지정의 실현을 위한 토지공개념 도입은 지속적인 정책과제로 강조될 수밖에 없다.

본 연구는 제도사적 관점에서 토지제도의 변이과정을 분석하여 미래지향적인 토지공개념 제도의 창출을 위한 분석적 근거를 제공하는데 주안점을 두고 있다. 주요 분석대상은 각 시대별 주요 토지제도의 근간이 되는 토지이념과 토지 관련 제도로 설정하였다. 토지공개념은 토지의 소유를 중심으로 논의되어 왔으며, 이는 각 시대별 토지에 대한 소유관계나 기타 정책적 시도의 변천과정을 이해함으로써 토지공개념의 변천을 명확하게 이해할 수 있기 때문이다. 본고는 제도사적 분석을 통해 전통적인 왕토사상에 근거한 토지국유 원칙이 현대의 토지공개념으로 재구성되는 과정을 시계열적으로 설명하고 있는 장점을 가지고 있다. 특히 지금까지 토지공개념과 관련된 선행연구 대부분이 토지공법적 측면에서 법률적 해석과 규제의 방향을 중심으로 이루어진 경향과 달리 제도사적 분석으로 설명하고 있는 본 연구에서는 시대별 제도변이의 특징을 찾을 수 있을 것으로 기대된다.
