2012년 〈지적재조사에 관한 특별법〉 제정의 민사법적 함의

지적재조사 특별법의 제정이 민사법과 토지소유권에 미치는 함의를 검토했다.

The Korea Ministry of Land and Transport undertook cadastral resurvey projects in 2012 in order to efficiently manage land. For the purpose of this, the korean National Assembly enacted a special law, Special Act on Cadastral Resurvey. The goal of this special law is to contribute to the efficient management of national land and the protection of people’s ownership, by correcting wrong registrations in cadastral records, which do not match the actual status of land, and changing paper cadastre to digital cadastre. I participated in Research Project for Enacting of Special Act on Cadastral Resurvey, which was performed in 2011 by Korea Association of Comparative Private Law.

The researched contents of this Project could not direct contribute to enacting Special Act on Cadastral Resurvey, but it took a lot of innovative and creative thinking as follows, (1) introduction of Unified Cadastral Record (2) introduction of Register of Underground Structures (3) introduction of Register of partitioned Superficies.
