The conversion of farmland is defined as a use of cropland except for agricultural purposes and any betterment. There are different opinions about the regulation of the conversion of farmland.
One insisted that only the farmers can own their land to supply the food for a nation and preserve the environment of national land as a doctrine of the constitutional law and the farmland law stated. Another opinion said that we can increase the value of land as it should be encouraged to converse the farmland, which takes 18.31 percentage of national ground into the land for urbanization except for highly competent cropland influenced by the stream of industrialization and urbanization.
After a reform of agricultural land in 1950s, a tenant farmer (a peasant) was no longer existed, as the system of a dirt farmer began and a principle that only farmers can own land and land is not the object of speculative investments has been consistently propelled. Even there exist several restrictive policies before the farmland law first enforced in 1996. For example, there were requirements of paperwork showing an approval for a transaction of farmland and residential territory preservation that a farmer should live within a 20-kilometer radius from his cropland. Also there was a duty of residence for 6 months beforehand.
After the law executed, the requirement of residential territory preservation was abolished, and the duty of residence for 6 months beforehand was repealed except several areas. In addition, anyone can own agricultural land under the approval two commissioners with the certification of his qualification. Precisely, the farmland law emphasizes upon supervision of the post acquisition of cropland. After taking position of agricultural land, it should be verified if the land is used for agricultural cultivation. If not, there would be administrative punishments such as a disposition order, an execution of disposition, and a disposition by compulsion.
Although the system of a landed farmer who is an owner and the principle that only farmers can own land, and land is not subjective to speculative investments have been a foundation about the agricultural land, the foundation is realistically collapsed through the permission of farmland owners other than farmers and a farmland banking system. It provides important information about the vision of policies about regulations of farmland. The number of cropland owners other than farmers increases as the size of farmland for the purpose of rent and trust through the Farmland Bank of Korea Rural Community & Agricultural Corporation grows.
Opening of the market of agricultural products to foreign countries would be inevitable through the negotiations of DDA, FTA, and WTO. Many farmers who are less competitive to the foreign agricultural producers would leave their agricultural land due to reduced income. We expect that the proportion of unused and uncultivated farmland would increase sharply with time. There is no persuasion in the policy of preservation of farmland in the situation of that agricultural industry only contributes to the 3.2 percent of GDP. Modern humans who have a value on economic growth and the quality of their life of the members prefer to live in the city where many public conveniences are installed.
The government should supply an urban site of land to fulfill the requirement of members. The government has to develop the rural community adjacent to the urban area. So conversion of farmland for other usages is unavoidable. Highly competent farmland must be protected. However, unproductive agricultural land should be developed to increase efficiency. Diversion of farmland into the urbanization usages is essential. The The diversion should be well planned before the implementation to prevent any difficulty of the development in advance. We can also prevent any misuse of the conversion and the development as we set the proper building-to-land ratio and the floor area ratio.
We need a strong policy for the redemption of extra income from the development and the conversion and for its redistribution. The change of new governmental urbanization policies from areas of sparse population to the areas of dense population is justified for the stabilization of real estate price. At the same time, it
