정비사업전문관리업 제도개선에 관한 연구

정비사업전문관리업의 제도 개선 방안을 연구했다.

2003년 7월 1일부터 시행된 「도시 및 주거환경정비법」에서는 정비사업의 시행 과 관련된 업무를 조합으로부터 위탁 또는 자문할 수 있는 정비사업전문관리업자를 선정하여 조합 업무의 비전문성을 보완하고, 정비사업 전 과정의 업무를 수행하므로 전문성과 실무능력을 갖춘 정비사업전문관리업자의 필요성을 갖게 하였다. 추진위원회 또는 조합은 정비사업 업무를 위탁할 수 있는 전문성이 있는 전문인 력의 필요성이 가장 중요하다는 것이 나타난다. 하지만 현행법으로는 전문성을 확인 할 수 없으며, 그에 따른 업무종사자들의 전문지식 부족으로 정비사업에 대하여 자 문 등 정비사업전문관리업의 업무대행을 완벽하게 수행하지 못하여 발생되는 피해는 추진위원회 또는 조합에서 전적으로 받게 된다. 그에 따른 정비사업 관련 전문성 부족, 시공사 등 협력업체 선정에 따른 이권 개 입, 정비사업전문관리업에 종사하는 임.직원의 능력 부족과 잦은 교체로 인해 정비 사업 관련 업무처리 지연과 정비사업전문관리업제도의 문제점을 본 연구에서는 다 음과 같이 제시하였다. 첫째, 정비사업전문관리업자의 기술인력의 확보기준 강화에 대한 개선방안을 제시 하였다.

추진위원회 또는 조합은 조합설립인가의 신청에 필요한 업무 대행, 구역 현황에 맞는 사업성 검토, 시행계획서의 작성, 사업시행계획인가의 신청에 필요한 업 무 대행, 관리처분계획의 수립에 필요한 업무 대행 등을 수행할 수 있는 전문인력이 필요하다. 결국 정비사업전문관리업의 업무종사자 중 위탁업무를 원만하게 수행할 수 있는 기술인력을 확보하기 위해서는 정부 차원에서 기술인력 확보를 위한 기준 을 강화하는 것이다. 둘째, 정비사업전문관리업의 업무종사자들을 체계적이고 체계적으로 등록할 수 있는 시스템을 확보하여 정비사업을 추진하고자 하는 추진위원회 또는 조합에서 정보를 쉽게 확인할 수 있는 시스템 도입이 필요하다. 셋째, 정비사업전문관리업의 업무종사자들의 전문성을 우선으로 할 수 있도록 정 부주도로 전문 교육 과정 개설이 필요하다. 따라서 이제는 정부가 적극적인 정비사업전문관리업의 재도개선 의지를 가지고 정비사업전문관리업의 업무종사자들의 의무교육을 시행하고, 그에 따른 전문인력이 정비사업 전 과정의 업무를 수행하게 됨에 따라 전문성과 실무능력을 갖추어 추진 위원회 또는 조합의 업무 대행을 투명하게 추진할 수 있도록 하며, 보다 안정적이고 합리적인 사업을 추진해 나갈 수 있게 될 것이다.

However, the current law cannot confirm expertise, and the damage caused by the inability to fully perform the duties of the maintenance business management business, such as advice, due to the lack of expertise of the workers, will be received only by the promotion committee or the union. As a result, the problems of the maintenance business-related lack of expertise, intervention in the selection and interest of suppliers such as construction companies, lack of ability of executives and employees in charge, frequent replacement of executives and employees in charge, and delayed maintenance business management system were presented as follows.

First, it suggested an improvement plan for strengthening the standards for securing technical manpower of maintenance business professional management companies. The promotion committee or association needs professional manpower who can perform the tasks related to the application for approval of the establishment of the association, the preparation of an implementation plan for business feasibility review and maintenance projects, the application for approval of a project implementation plan, and the establishment of a management and disposition plan.

In the end, the government will strengthen the standards for securing technical manpower at the government level to secure financial resources as technical manpower who can carry out consignment tasks smoothly among workers in the maintenance business professional management industry. Second, it is necessary to introduce a system that can easily check information from the promotion committee or association that wants to promote the maintenance project by securing a system that can systematically and continuously register workers in the maintenance business management business.

Third, it is necessary to open a professional curriculum to foster professional manpower led by the government through compulsory education for workers who have been formally operated so far. Therefore, the government will now implement compulsory education for workers in the maintenance business management business with the will to improve the government's active maintenance business, and as professionals carry out the entire maintenance business, they will be able to transparently promote the work of the promotion committee or union, and promote more stable and reasonable projects.
