Excavation shall be conducted when relics are revealed during the construction process.
All cultural assets excavated during the excavation will be attributed to the state, and the land will be regulated as a preservation measure and designated as a cultural heritage preservation area, cultural property protection zone, and height districted area according to historical, artistic, and academic values, which will make it virtually impossible to exercise property rights due to restrictions on the construction, expansion, and renovation of buildings.
In most excavation sites, except for small-scale excavation surveys, all excavation and investigation expenses shall be borne by the development project implementer, and the project cost shall be increased due to delays in construction. Since property rights are restricted without proper compensation, many construction developers do not report artifacts to the Cultural Heritage Administration or local governments and choose illegal methods to destroy burial cultural assets or break down land.
In this study, data and precedents related to loss compensation were considered to determine the cause of conflict between preservation, development and compensation between cultural property protection and development projects. In order to find a win-win relationship, the government studied the loss compensation regulations of major countries, and based on this, draft improvement measures were drawn up and objectivity was confirmed through empirical analysis.
As a result, it is intended to provide more effective protection of burial cultural assets and legitimate compensation for losses by presenting problems and improvement measures related to the excavation of burial cultural assets as follows: First, the regulations that pass on the cost of excavation and investigation of burial cultural properties to the developers should be improved. Second, proper compensation should be given to the people who are subject to property rights restrictions due to the excavation of burial cultural properties. Third, an alternative to loss compensation is needed to ease the burden of national finance.
Fourth, land that has become impossible to use property rights due to preservation measures for the protection of burial cultural properties needs tax exemption. Fifth, needs the revision of local regulations for land that has become impossible to exercise property rights that the state can actively accept. Sixth, funding is needed to compensate for the loss. These problems and the need for improvement were highlighted by the following improvement measures.
First, the state and the development project operator shall pay half of the expenses incurred in excavating the cultural heritage of the burial, regardless of the area, and the state shall bear all the expenses incurred in excavating the cultural heritage in stages when the foundation for financial resources is prepared. Second, compensation equivalent to one-half of the price of the burial cultural property excavated shall be paid to the owner of the land or the implementer of the development project.
Third, the provision of concessionary compensation shall be newly established to return part of the excavated artifacts within the extent equivalent to the amount of compensation, except in cases where the State needs to possess them. Fourth, the entire amount of property tax shall be reduced or exempted for land that has been preserved on site due to the excavation of buried cultural assets. Fifth, the right to purchase land that has been preserved on-site by the state should be introduced.
Sixth, it is worth considering the introduction of the Cultural Heritage Lottery Fund and Objective tax and the introduction of a special levy on items to be paid for civil engineering and construction permits in order to secure funds. Through this, the government can ease the financial burden of the nation by protecting cultural heritage, creating education and employment related to cultural heritage, discovering cultural assets, and compensating landowners.
As mentioned above, this research was intended to present the problems of property rights restrictions due to the excavation of burial cultural assets and reasonable compensation for losses, and to analyze the causes of conflicts between preservation, development and compensation bet
