「지적재조사에 관한 특별법」의 입법과정과 향후 과제

지적재조사 특별법의 입법과정과 사업 수행 과제를 검토한다.

오랜 기간 동안 표류되었던 「지적재조사특별법안」이 국회를 통과됨에 따라 성공적인 지적재조사사업 수행을 위한 안전정적이고 실천적인 법적 토대가 강력히 요구되고 있다. 따라서 본 연구는 입법예고 되었던 「지적재조사특별법안」을 비교·검토함으로써 「지적재조사특별법안」내용의 실효성과 타당성을 확보하며, 향후 지적재조사사업 수행의 견고한 법적 토대를 마련하는데 목적을 두고 있다. 이러한 연구목적을 달성하기 위한 대상 및 범위는 「지적재조사특별법안」으로 한정하고, 조사방법은 문헌조사를 통한 2차 자료를 수집하여 「지적재조사특별법」의 개념적 논의 및 접근 틀을 설계하였으며, 접근방법은 기술적 접근방법과 비교론적 접근방법을 병용하여 적용하였다. 연구결과는 다음과 같은 관점 및 내용에서 검토되었다. 첫째, 「지적재조사특별법」의 입법경위와 접근 틀은 지적재조사, 특별법의 입법경위, 선행연구 및 접근 틀 차원에서 검토하였다. 둘째, 특별법의 입법과정 및 접근 틀의 적용은 특별법의 입법과정, 접근 틀의 적용 및 검토 차원에서 접근하였다. 셋째, 「지적재조사특별법안」의 한계 및 향후 과제는 특별법의 한계, 향후과제 및 대안 등의 관점에서 이루어졌다.

Recently, Special Act on Cadastral Resurvey Project passed the National Assembly and thus stable and practical legal foundations for implementing successful Cadsstral Resurvey Project are strongly required. For that reaseon, the purpose of this study is to prepare concrete legal foundations for implementing Cadastral Resurvey Project in future and to secure feasibility and validity of contents of Special Act on Cadastral Resurvey Project by comparing and reviewing Special Act on Cadastral Resurvey Project that have been legalized.

To achieve the purpose of the study, the research subject and scope are limited to Special Act on Cadastral Resurve Project and survey was carried on through collecting the secondary research data by literature review and the conceptual review and approach framework was established based on it. And a descriptive and comparative approach is applied concurrently. The conclusions of the study are produced from 3 following aspects as follows : First, details of legislation and approac h framework of Special Act on Cadastral Resurvey Project was examined in terms of Cadastral Resurvey, details of legislation of Special Act, advanced research and approach framework.

Second, legislation process of Special Act and application of approach framework was conducted as a viewpoint of legislation process of Special Act, the review and application of approach framework. Third, limitation and problems to be solved of Special Act on Cadastral Resurvey Project referred to the limitation of Special act, its problems to be solved and alternatives.
