[Purpose]This study aims to investigate the legal issues surrounding the tax authority's disposition that denies the exclusion of rental housing from the comprehensive real estate tax base.
Specifically, the denial was based solely on a discrepancy in the business type code on the tax registration certificate, despite the taxpayer practically operating a rental business. The primary objective is to clarify the legal nature of the rental business registration under the Special Act on Private Rental Housing as opposed to the business registration under tax law, and to examine how the tax authority’s formalistic disposition infringes upon the non-taxation practice and the principle of protection of legitimate expectations under the Framework Act on National Taxes.
[Methodology]This study conducts a comparative analysis of Supreme Court precedents by strictly categorizing the procedural obligations required by statutes for tax exemptions into “validity provisions” (which create substantive rights and obligations) and mere “obligations to cooperate.” Furthermore, it evaluates the legal validity of the taxation disposition by subsuming the specific factual relations of the case under the requirements for establishing a non-taxation practice as stipulated in Article 18, Paragraph 3 of the Framework Act on National Taxes.
[Findings]The legal review confirms that the substantive rights and obligations of a housing rental operator are established through registration under the Special Act on Private Rental Housing, whereas the business registration under tax law is merely a confirmatory “obligation to cooperate” aimed at determining the tax base. Thus, if a taxpayer fulfills the substantive requirements under the Special Act on Private Rental Housing and completes the report for the tax base exclusion, the tax benefit cannot be revoked based solely on a formal error in the business type code on the registration certificate.
Moreover, because there exists an objective fact that the tax authority has approved the exclusion over a long period without contesting the code discrepancy since the legislative amendment in 2008, this study demonstrates that retrospectively reversing this stance to collect the comprehensive real estate tax constitutes a direct violation of established non-taxation practices and the principle of protection of legitimate expectations. [Implications]Tax administration must depart from formalistic proceduralism and exercise its taxation power based on substantive legality.
The tax authority should fully guarantee the appropriate tax benefits in light of the legislative intent of the comprehensive real estate tax exclusion system, which fundamentally aims to stabilize residential living through the supply of rental housing. Ultimately, this research holds profound significance as it safeguards the legal stability of taxpayers and provides a definitive legal rationale—grounded in the substance-over-form doctrine—for future tax appeals and litigation practices.
