Real estate is inseparably related to daily life, while it reminds many people of a speculation. Real estate agents have played an important role in its market, but it is a fact that they have been blamed considerably. This is related to the unbalanced change in the price of real estate recently. Its unscientific distribution structure has made the dealing disordered and the prevailing speculation has caused many social problems. The government established the law of agency of real estate in December, 1983 to settle these problems, however, this law started with many other problems at its beginning.

I looked into the controversial points in the system of real estate agents dualized under this law, in the unreasonable structure of commission, and in the premodern general contract system. To settle all these problems basically, the system of agents should be unified centering around the certification system and their education should be reinforced at the same time. And the limit of commission should be abolished. It is rational to establish the commission by a mutual agreement between agent and client or by the rate of one percent of the transaction.

The general contract of reguest for agency which has many problems should be changed to the exclusive contract, and the contract of a proof mark to that of an official seal. The certificate of possession should also be obligatory as an essential document for registration. Furthermore, to cope actively with the trend of opening, specialization, and becoming enormous to the Real Estate Market and to protect Citizen's right of property, it is urgent to establish the law of a licensed real estate agent like that of an attorney, of a judicial officer, or of a licensed tax accountant.
