ABSTRACT A Study on the Promotion Plan of Special Exception Business in Long-term Non-executed Urban Parks through the Simulation Analysis -Focused on Neighbourhood Parks in Gwangju Metropolitan City- Kim, Ho-Gyeom Department of Landscape Architecture Graduate School Kyung Hee University In the past , Korea announced the decision of urban planning facility as urban management plan and then neglected it for 10 years or more long-term non-executed urban planning facility. In 1999, the Constitutional Court ruled that the restriction of private use of land without excessive compensation was too severe.
Therefore, the City Urban Planning Act was amended so that it would be automatically canceled unless a long-term non-executed urban planning facility is established by 1 July 2020. Urban parks occupy the largest area of long - term urban planning facilities, and in poor - financed local governments, most of the long - term urban parks are in danger of being lifted due to lack of funds. Therefore, seven years have elapsed since the special provision was enforced in the Decree of the Park Green Area Act in December 2009 in order to resolve the unrecognized urban park. However, the cases of private park construction are rare and the special exception business is poor.
The reason for this is the delayed implementation of long-term unexplored urban park special projects due to the complexity and uncertainty of licensing procedures for private parks, uncertainty about securing profitability of private park owners, market conditions, and other factors. Private parks based on special exception business are proceeding smoothly because demand and business margin of profitable facilities in non-park facilities are good in Seoul and the metropolitan area. However, we analyzed the possibility of private parks for exceptional projects in Gwangju Metropolitan City, which has the lowest population and financial independence among the metropolitan cities.
The results of the simulation analysis according to the adjustment of the business margin and the floor area ratio are as follows so as to secure the proper profit of the proprietor of the private park promoted as the special exception business. In order to secure the optimal return rate (5 ~ 7%) based on Net Present Value (NPV), we proposed the change of purpose of area and the floor area ratio, and presented the criteria to the private park developer and the person in charge of Gwangju Metropolitan City. The five parks (Central Park, Songjeong Park, Bongsan Park, Ilgok Park, Surang Park) are the second or third class all-day residential areas of the non-park facility site.
Because of good business feasibility in these regions, it is possible to convert them to private parks if the purpose of them are changed. However, four of them are expected to have difficulty in promoting them to private parks because the urban planning committee deliberation is accompanied by a change of purpose in the quasi - residential area or more. In the case of Seoul and the metropolitan area, it is expected that the project will be smoothly implemented due to the good profitability of the sale price (B) of the apartment. However, in the case of the provincial cities, the expenditure is relatively high.
(C) It is difficult to promote special exception business because of low business feasibility caused by low sale price and the relative decrease in cash inflows. In-depth interviews were also conducted with officials in charge of the municipalities in Korea, which are in the process of leading special exception business. Most of the special exception business are in the early and middle stages, but Uijeongbu is pursuing(promoting or implementing) the latter stage. However, many unexpected problems have arisen in the course of the special exception business, so the system for the smooth promotion of private park should be enhanced as follows.
As a result of the in - depth interviews, the greatest obstacle to promoting the special projects was difficulty in applying the related laws. The most important and urgent issue is the ordinance maintenance. Although the Special Act on the Development Act in the Urban Park Site is stipulated in the 'Park Green Land Act', the special project is the urban planning facility project under the National Land Planning Act. Therefore, the Urban Parks should be resolved promptly through the enactment of the Special Act for the Establishment of Long-term Undeveloped Urban Parks for a limited period of time, by dealing with agendas of related laws and shortening the period of licensing.
Legislative improvements include the revision of the National Land Planning Act, including the introduction of compulsory regulations for the implementation of the Step-by-Step enforcement plan related to the National Land Planning Act, financial support from state subsidies, improvements to free assignments, Amendments to the Compensation Law, amendment of the park greening laws to supplement the national city parks and increase the ratio of non - park facility sites, and amendment of the local tax exemption restriction law to extend the tax cuts of the incorporated parks.
The details of the application of the "Special Guidelines" for the promotion of private parks include the conclusion of agreements for raising funds, reducing financial costs, adjusting cash reserves, (Change of use), adjustment of timing of change, adoption of managing the total amount combined with several urban parks in the city, approval of the housing construction project of the non-park facility site, and so on. Finally, it is necessary to improve the system related to the operation of the private park system before starting the sunset of the long-term non-executed urban park.
It is also required to review and improve the design of Task Force Team and the roles of control tower, central government and local government, change of paradigm of local government and support plan, implementation proces
