The gratuitous vesting system of infrastructure facilities under the Act on the Improvement of Urban Areas and Residential Environments (Urban Renewal Act) originated from the gratuitous vesting system of public facilities under the National Land Planning and Utilization Act.
These systems share a reciprocal structure in which public facilities installed via development projects are vested in the competent authority, while the project operator receives gratuitous transfer of existing facilities within the scope corresponding to the installation costs of newly established facilities. However, since the Supreme Court rulings of 2008, the requirements and scope of gratuitous transfer under the Urban Renewal Act are interpreted and applied differently from those under the National Land Planning Act. This has prompted sustained criticism regarding inequities in application outcomes and lack of uniformity in the legal framework.
This research explores the improvement of the gratuitous vesting system of infrastructure facilities, which had been operating contrary to its legislative purpose because of judicial interpretation, via statutory reform. The study categorizes the gratuitous vesting systems across multiple development statutes into three types based on legislative form and scope of subject facilities, and examines the distinctive characteristics of the infrastructure vesting system under the Urban Renewal Act. Thus, it analyzes the legislative intent and institutional significance of the 2026 amendment to the Urban Renewal Act. The 2026 amendment can be evaluated from two perspectives.
First, it addresses the irrationalities arising from judicial interpretation by stipulating in law that State-owned de facto roads and existing infrastructure facilities not designated as urban planning facilities—previously both had been excluded from gratuitous transfer—are now included within the scope of transfer. Second, the provision requiring that the installation costs of dedicated facilities be reflected in the calculation of the scope of gratuitous transfer, unlike other statutes such as the National Land Planning Act, represents a legislative advancement that realizes the purpose of the gratuitous vesting institution more faithfully.
However, the five-year sunset clause applicable to State-owned de facto roads remains a structural constraint. Further policy review regarding its conversion to a permanent provision will be necessary before the expiration of that period.
