토지등록 객체에 대한 보증보험제도 도입에 관한 연구

토지등록의 신뢰성과 소유권 보호를 위한 보증보험 도입을 연구했다.

국문초록 현대사회는 정보화의 급속한 발달과 함께 다양하고 편리한 생활환경을 제공하고 있다. 그러나 대부분의 사람들은 안전성과 정확성을 담보 받지 못하는 것들에 대해서 신뢰받는 기관으로부터 보증받길 원하며 더 나아가 보험이라는 안전장치까지 마련하고 있다. 그런데 우리가 소유하는 토지와 그 위에 존재하는 많은 관련정보들에 대해서는 국가가 조사하고 등록하는 내용에 대해 막연히 믿고 살아갈 뿐 국가도 우리도 지금까지와는 다른 보다 발전된 형태의 제도적 안전장치를 만들지 못했던 것이 사실이다. 그래서 본 연구에서는 지적제도에서 추구하는「국토의 효율적 관리」와「토지소유권 보호」의 두 가지 목적을 시대적 흐름과 경제원리에 맞춰 새로운 재산권 보호 장치를 만들고자 “토지등록 객체에 대한 보증보험제도”의 도입을 연구하였다. 이를 위해 토지등록 및 보증보험에 관련된 이론적 고찰을 통해 개념정립의 기초를 세웠으며, 지적 및 보험전문가 집단을 중심으로 설문조사를 실시하여 제도 도입의 타당성을 검증하였고, 보증보험제도 도입에 따른 세부적 절차와 구성 연구를 통해 효율적인 도입방안을 제시하였으며, 이에 대한 기대효과를 제시하고자 하였다. 이와 같이 토지등록 객체에 대한 보증보험제도의 도입은 예측하기 어려운 토지가치의 변동과 위험요소에 대비해 현대사회가 갖추어야할 필수적인 제도장치가 될 것이며 이를 통해 보다

안전한 토지소유권 보호와 건전한 부동산거래 확립을 도모할 수 있을 것이다. 주요어 : 토지등록 객체, 보증보험, 보증보험제도, 토렌스시스템 ABSTRACT Modern society provides convenient living environments through the rapid development of information technology. However, people feel that security and accuracy are not always guaranteed and they want the guarantee from trusted organizations. Furthermore, insurances have been introduced as a safety measure. As for land we own and lots of information related to it, however, we vaguely trust the registration records of the government. It is true that we have not yet made secure legal safety measures regarding land registration.

Therefore, this study aims to suggest a new method to protect one's property rights pursued in the cadastral law, "efficient land management" and "property right protection", by accommodating the current situation and economic principles. For the purpose, this study suggests the deployment of "the guarantee insurance system for land registration objects". Basic concepts for land registration and guarantee insurance have been established through theoretical investigation. The validity of the introduction of the system has consolidated through a survey among experts in land registration and insurance areas.

Also, deployment methods have been suggested for the efficient introduction of the guarantee insurance system. The methods include detailed procedures and expected effects. The guarantee insurance system for land registration objects could be an effective legal system against land value fluctuations and risk factors in modern society. Also, this system will be helpful for protecting property rights and establish sound real estate transactions.
