우리나라 농업진흥지역 지정·관리제도의 개선방안에 관한 연구

농업진흥지역의 지정·관리제도와 개선방안을 연구했다.

농지는 국민의 식량공급과 국토환경보전의 기반이고 농업과 국민경제의 균형있는 발전에 영향을 미치는 한정된 귀중한 자원이다. 따라서 소중히 보전되어야하고 공공복리에 적합하게 이용?관리되어야 하며, 그에 관한 권리의 행사에는 필요한 제한과 의무가 따른다. 농지는 생산성을 높이는 방향으로 소유·이용되어야 하며, 국가 및 지방자치단체는 농지에 관한 기본이념을 구현하기 위하여 농지법을 중심으로 관리·보전하고 있다. 산업사회로 접어들어 농지의 수요는 계속 늘어나고 이를 보다 효율적으로 이용하고 관리·보전하기 위해서 제도의 개선이 요구되고 있다. 본 연구에서는 이런 시대적 추세에 의해 이루어졌으며 총 5장으로 구성하였다. 제1장 「서론」에서는 본 연구의 목적과 함께 연구의 방법과 범위에 대해 기술하였다. 제2장 「우리나라 및 외국의 농지제도 개괄」에서는 그 동안 우리나라 농지제도의 변천과정을 살펴보았으며, 농지법에서 규정하고 있는 우리나라 농지제도중 농지의 소유 및 거래제도, 농지의 이용증진제도, 농지의 보전 및 전용제도와 기타 농지제도 등을 개괄적으로 살펴보았다. 또한, 독일, 일본, 대만의 농지소유 및 거래제도와 농지의 이용 및 보전제도에 대해서도 검토하였다. 제3장 「농업진흥지역 지정·관리제도」에서는 우리나라의 대표적인 농지관리제도인 농업진흥지역제도에 대해 제도도입 및 지정연혁을 살펴보았으며, 지정개요 및 현황과 관리실태 등을 검토하였다.

제4장 「농업진흥지역제도의 문제점 및 개선방안」에서는 관리상의 문제점과 제도상의 문제점을 구분하여 소유 및 거래제도와 농지조성비 부과, 농업진흥지역지원제도에 대한 문제점을 고찰하고, 그에 대한 개선방안을 지역균형발전 측면에서 고찰하였다. 제5장 「결론」에서는 연구결과를 요약하여 정리하고 농업진흥지역제도를 현실에 맞게 개선하고 보완함으로써 지역개발은 물론, 지역간 균형발전과 농업구조개선에 미치는 영향을 제시하였다. The farmlands are the base for providing the people with foods and preservation of environment as well as the limited precious resource influencing the agriculture and balanced development of national economy, so they must be carefully preserved, used and managed to be suitable for the public welfare.

The limit and responsibility are followed in exercising the rights of farmlands and the farmlands must be used and owned to the direction of increasing the productivity, and the government and local government manage and preserve the farmlands focused on the laws of farmlands in order to actualize the basic idea regarding the farmlands. The demands for the farmlands keep increasing as the communities are getting industrialized. Therefore, the improved systems are required for using, managing and preserving the farmlands more effectively. This study consisting of five (5) chapters was performed to correspond to these current trends.

Chapter 1 The purpose of this study and researching scope and method are stated in this "Introduction." Chapter 2 In the part of generalization "Farmland systems in Korea and foreign countries", changing process of our farmland system is reviewed, and overall farmland systems stipulated in our laws of farmlands such as ownership and transactional systems of farmlands, using promotional system of farmland, preservation and exclusive using system of farmlands are reviewed. Also, ownership and transactional systems of farmlands, using and preservation system of farmlands in Germany, Japan and Taiwan are reviewed.

Chapter 3 In the system "Designation and management of farming promotional area, introduction background and designation history of system regarding the farming promotional areas, which is our representative farmland management system, and the designation and management status of farming promotional areas are reviewed as well.

Chapter 4 In this chapter of "Problems and improving plan of system of farming promotional areas", ownership and transactional systems and problems in the systems of imposing the fees for the farmland development and supporting the farming promotional areas are considered after classifying the problems in the system and management and their improving plans are considered as well in terms of the balanced development in districts.

Chapter 5 In the "Conclusion", the plans and effects influencing the development and balanced developments in the districts and farming structural improvement are suggested by summarizing and sorting the researching results and improving and complementing the system of farming promotional areas.
