정비사업의 현황과 건설사업관리(CM)제도의 도입 방안에 대한 연구 : 재건축·재개발사업을 중심으로

재건축·재개발 정비사업에 건설사업관리제도를 도입하는 방안을 연구했다.

Recently, the maintenance work has been transformed to restore urban space and to recover urban function escaping from the development-based logic and focused on the unit of wide area from that of individual business. The law of maintenance for urban and residential environment that came into effect from July first in 2003 has excluded the urban residential environment until now and has taken the form of pre-planing and post-development with banning the form of excluded profit for union members.

And also it made the condition of maintenance work difficult with reinforcing check for the safe and the official permission for the plan of management and disposition, so that the present way of maintenance work can not confirm the success of maintenance business. This study stressed the role of construction management system in the maintenance work by comparing the expert management of maintenance system with the present management of it.

And also it addressed the problems to be considered for the construction management system to take the practical role in the maintenance work and made an effort to seek the complementary method, so as to suggest a progressed direction to which the construction management system has to forward with activation. First of all, this study reviewed the overall outline of the new law of maintenance for urban and residential environment, the combined law, based on the changed contents and maintenance-related rule and its changed procedure. And then it researched and analysed the problems in proceeding the work and for its improvement.

Second, as the new expert management of maintenance system is the rule for implementing redevelopment and reconstruction so it mainly focused on the redevelopment and reconstruction among the maintenance works, at first and then reviewed overall expert management of maintenance system. Third, it reviewed the concept of construction management, its trend, and the skill for each stage. And also it researched the kinds and methods to connect the procedure of construction management for redevelopment. The purpose of this study was to prepare a foundation to establish efficient operating guide by examining the problems in construction management and acquiring the complementary subjects.

최근의 정비사업은 개발중심의 논리에서 탈피하여 도시공간의 재생과 도시기능의 회복으로 전화되고 있으며, 개별사업 단위 중심에서 광역단위 정비사업으로 인행되고 있는 상황이다. 2003.7.1일부터 새로이 시행된 도시 및 주거환경정비법은 현재까지 도시주거환경은 배재하고 조합원들의 이익만을 추구하는 형태의 정비사업을 지양하고 선계획-후개발 형식을 취하고 있으며, 안전진단 강화, 관리처분계획의 인가 등 정비사업의 요건을 보다 어렵게 함으로서 기존의 정비사업 수행 방식으로는 정비사업업의 성공을 보장할 수 없게 되었다. 본 논문은 건설사업관리제도를 정비사업전문관리제도 및 기존 정비사업관리제도와의 비교분석을 통해 정비사업에 있어 건설사업관리제도가 가지는 역할에 대한 필요성을 역설하고, 건설사업관리제도가 정비사업에 실질적인 역할을 할 수 있도록 고려되어야 할 문제점과 보완방법을 보색하여 건설사업관리제도가 정비사업에서 활성화 되어 앞으로 나아가야할 발전방향을 제시하기 위해 노력했다. 그 중 첫째로 통합법인 도시 및 주거환경정비법의 법제정으로 인해 달라진 법재정으로 인해 달라진 법제의 내용을 중심으로 도시 및 주거환경정비법의 전반적인 개요를 살펴보고 정비사업의 관련규정 및 변경된 절차를 살펴보고, 추진과정에서 발생하는 문제점 및 개선방향 등에 대한 조사, 분석한다.

둘째, 신설된 정비사업전문관리업제도가 재개발사업 및 재건축사업을 시행하는데 따른 규정이므로 정비사업 중에서 주로 재개발·재건축사업에 중점을 두고 검토한 후 정비사업전문관리업제도를 전반적으로 검토하였다. 셋째, 건설사업관리에 대한 개념, 동향 및 건설사업단계별 건설사업관리 요소기술에 대해 살펴보고, 재개발사업에 대한 건설사업관리의 절차를 접목시키기 위한 종류와 방법에 대하여 연구한다. 이러한 연구를 통하여, 건설사업관리의 문제점과 보완과제를 습득해 향후, 효율적인 운영지침을 수립할 수 있는 기틀을 마련하는데 목적이 있겠다.
