자원배분 메커니즘으로서의 용도지역지구제: 미국의 용도지역지구제를 중심으로

미국의 배제적 용도지역지구제를 자원배분 메커니즘으로 분석한다.

This work discusses the exclusionary zoning in U.S. as a form of resource allocation by zoning. First, thisresidential uses, the motivations and resource allocation effects of exclusionary zoning are addressed. Third, in the processof exploring exclusionary zoning in terms of the U.S. constitutional principles, we present that the public interests thatzoning must serve at the level of the constitutional principles have likely different range than the public interests perceiveddiscussion of the evils of exclusionary zoning in the U.S. context. 본고는 용도지역지구제(zoning)에 의한 자원배분의 한 형태로서, 미국의 적지 않은 지방정부들에서 특정 사회계층을 배제하기 위해 시행해오고 있는 배제적 용도지역지구제(exclusionary zoning)를 고찰하였다.

첫용도지역지구제에 초점을 맞추어서, 그러한 제도의 시행 이면에 있는 동기와 그 제도가 갖는 자원배분효과를논의하였다. 셋째, 그러한 배제적 용도지역지구제를 미국 헌법의 기본원리의 관점에서 고찰하는 과정에서, 용도지역지구제가 헌법적 원리의 수준에서 기본적으로 추구해야 하는 공공이익(public interests)이 배제적 용도을 지적하였다. 그리고 이러한 차이에 대한 고려가 미국의 상황에서 배제적 용도지역지구제가 갖는 부정적영향에 대한 논의를 더욱 풍부하게 하기 위해서 필요하다는 점을 제시했다.
