Despite the global standards established by the Financial Action TaskForce (FATF), the implementation of Anti-Money Laundering andCountering the Financing of Terrorism (AML/CFT) measures in the realestate sector differs widely across jurisdictions due to varying riskperceptions, legal frameworks, and institutional capacities amongDesignated Non-Financial Businesses and Professions (DNFBPs). Korearepresents a significant regulatory gap, as most real estate actorsremain outside the scope of AML obligations.
The expansion of AMLrequirements in the Korean real estate industry is therefore essential As money laundering typologies increasingly extend beyond traditionalfinancial channels, real estate markets lacking AML oversight faceheightened vulnerability to illicit value transfers.
Strengthening AMLobligations in this sector would enhance compliance with internationalstandards, promote transparency, and prevent the inflow of illicitdomestic and foreign funds. This study proposes three directions for expanding AML obligations inKorea’s real estate sector: (1) applying the principle of “sameactivity, same regulation” across all revenue-generating real estateactivities, supported by amendments to the Act on Reporting and UsingSpecified Financial Transaction Information; (2) establishing a risk-basedsupervisory framework with systematic monitoring and industry-specificinternal control guidelines; and (3) implementing mandatory AMLtraining supported by standardized materials. While limited by the lack of domestic discourse and prior research, thisstudy highlights the necessity of comprehensive AML adoption.
Futureresearch should develop more detailed legislative pathways tostrengthen Korea’s alignment with global AML standards.
