公法上 土地所有權의 規制類型에 關한 硏究

공법상 토지소유권 규제의 유형과 관련 법제의 문제를 연구했다.

There are about 120 laws, which regulate land, in Korea. The main purpose of making such laws is to provide legal foundations for the economic development and national physical development, which were started in the early 60's. It is highly that such a many play important roles in bringing about economic growth. However, such laws lacks systemic structures. It is revealed that such laws cause many conflicts and problems between of public welfare, promotion and protecting private land ownership. Study results can be summarized as follows.

1) Considering foundations and limits of land ownership I can conclud that land should be emphasised in terms of its publicity, social purpose, and it relativeness. so we can solve problems by changing, land definitions from public interest to common interest. 2) We can devide regulation types into. 1. Contention the land use returns continuously. 2. regulation on the land purchage and sale. 3. public law regulation on the land ownership should be made within the range of social limits and public needs. 4. We should introduce supreme planning right to provide prefiltering system for the realization of public interest and protection of private land ownership right. 5.

finally we should make basic land law which coodinate dual characteristics of land.
