일본의 토지가옥조사사 제도에 관한 연구

일본 토지가옥조사사 제도를 검토하고 토지 경계 분쟁 대안을 모색했다.

The Primary purpose of this study is to critically review the Japanese Land and House Surveyor System and provide some policy alternatives for resolving our country's land parcel boundary disputes. This purpose can be divided into several detailed objectives as follows. Firstly, this research tries to find what kind of education a person needs to become a Land and House Surveyor in Japan. Secondly, this paper aims to reveal how a person becomes a Licensed Land and House Surveyor. Thirdly, this writer tries to review Land and House Surveyor's job duties and their code of ethics. Finally, this study suggested some policy alternatives for resolving our country's land parcel boundary disputes.

In order to achieve this purpose, reviews of the related literature were conducted. Our study results show that there is no university in Japan whose sole purpose is to educate would-be Land and House Surveyors. A person can become licensed by passing the Land and House Surveyor Licensing Examination administered by the Japanese Ministry of Justice every year. Land and House Surveyors job duties have been changed over time. Currently their main job duty is to help resolve land parcel boundary disputes without going to the court. These study results can provide policy implications for resolving our country's land parcel boundary disputes.

That is, if we introduce this kind of Land and House Surveyor System, we can resolve land parcel boundary disputes easily and quickly without going to the court. Therefore, we can reduce time and economic costs involving dispute resolution. Under this system, people can maintain good relations with their neighbors as wel 본 연구에서는 일본의 토지가옥조사사 교육기관, 자격제도, 그리고 업무의 특성 및 직업윤리 등을 파악해보고 이들이 우리나라의 토지경계분쟁의 해결에 어떠한 시사점을 주는지를 살펴보았다. 분석의 결과 오늘날 일본에는 토지가옥조사사를 전문적으로 육성하기위한 4년제 대학이나 전문대학의 학과들은 존재하지 않았다. 또한 토지가옥조사사의 자격을 취득하려면 일정한 요건을 구비한자로서 법무장관의 인가를 받든지 아니면 법무성이 실시하는 토지가옥조사사 시험에 합격해야만 한다. 시대적인 상황이 변화됨에 따라 토지가옥조사사의 역할도 변모하고 있다.

즉 초창기에는 단순히 부동산 표시등기에 필요한 조사측량과 등기수속신청 대리 업무를 주로 수행했으나 최근에는 토지경계분쟁을 조정하고 필계특정업무신청을 대행하는 등 토지경계분쟁해결의 전문가로서의 역할이 강화되고 있다. 이러한 경계분쟁해결의 전문가로서 토지가옥조사사의 역할은 전 국토에 대한 지적재조사사업을 추진하려고하는 우리에게 큰 시사점을 던져주고 있다
