The land of our country has both blessing and weakness. Although the size of the land is small, fertile soil, medicinal plants, and pure water can offer a great environment only if conservation efforts are successfully made. Before a modern state emerged, the land had been managed by a royal government which had planned and constructed anti-flood afforestations, castles, and the capital city.
The land then was possessed by the government in principle based on the thought of the 'royal road' Just like the king who was revered by the people for the good management of flood in those days, a government of today can secure people's trust by managing its land well. Land policy is one of the most important policies in any country; it not only affects the nation's economic policies but also has great implications to general welfare of the people. From the end of Yi Dynasty through the nation's liberation, our country, a colony of Japan, was forced to carry out a strategic land development.
This strategy was intended to exploit the land and to make it a passage for the Japanese invaders to the Continent. From the foundation of the Republic to the early 1990s, various policy measures, such as the Farmland Reform, land engineering, and the introduction of the 'public land' concept, have been carried out, and these policies have enabled the government to construct a comprehensive management system of the land. During this period, living standards of the people improved greatly as a result of the nation's economic development.
Nevertheless, the country has seen many unexpected consequences of the development: real estate speculations, regional imbalance in the development, environmental pollutions, and damages to the land. As these side effects caused serious social problems, a variety of rules and regulations were issued. But there have been conflicts among these regulations, especially between new ones and the old, and, often, between the central and local governments, because these regulations were revised neither on time nor in systematic manners. Therefore, the disorderly situation of the nation's land pol cy emerges as an important policy issue as we begin the new era of the 21st century.
The results of this study indicate that the land policy of our country has been in serious trouble because our land has severly suffered from: (1) the development in the wake of the green-belt relaxation, which damaged water reservoirs as well as mountains (2) construction of apartments and motels on semi-farmlands (3) environmental pollution caused by stock farms and factories (4) real estate speculations on restricted lands and the turmoils thereof (5) temporary relaxation of regulations, which prevented many rules and regulations from being revised in timely manners (6) many court decisions ruling special land laws unconstitutional, which spawned a number of lawsuits requiring compensation (7) damages that are indirectly influenced by political factors.
In order to solve these problems, we should study carefully and revise the relevant rules and regulations in such a way that promises a systematic management of our land. Unless we make significant improvements in this aspect, we are not able to secure sound environments, both social and natural, to live in. Nor can we pursue happy lives in a welfare state, which we have envisioned for a long time. This study is desired to serve as a threshold for future research in this area.
Among the many issues discussed above, the revision of numerous rules and regulations, many of, which are redundant, meaningless, and causing conflicts, is the most imminent task to which both the government and academicians should turn their attention as soon as possible.
