韓·美 兩國의 用途地域制度에 關한 比較硏究

한국과 미국의 도시계획상 용도지역제도를 비교했다.

本 연구는 都市計劃施行上 주요한 역할을 하고 있는 用途地域制度에 關하여 韓國과 美國의 制度를 比較硏究한 것이다. 韓國의 경우에는 전국 통용의 都市計劃法에서 用途地域의 種類와 그 指定權을 規定하고 建築法에서 각 지역에서의 建築行爲를 規定하고 있는데 반하여, 美國의 경우에는 원칙적으로 法制定權이 각 地方自治團體에 속해 있다. 따라서 韓, 美간의 用途地域制度를 일률적으로 비교하기는 어려움이 있으므로 美國의 경우에는 많은 도시의 用途地域制度 條例 制定에 큰 영향을 미친 뉴욕시의 用途地域制度를 선택하여 韓國의 都市計劃法上 用途地域制度와 비교검토 하였다. 연구의 순서는 먼저, 用途地域制度의 바탕이 되는 양국의 都市計劃制度의 變遷過程을 살펴보고, 다음에 用途地域制度의 變遷過程을 살펴본 후 現行 用途地域制度上 양국 用途地域의 指定目的과 種類 및 建築規制 內容을 살펴 보았다. 그리고 이 硏究웨 결과를 다음과 같이 도출 하였다. 1) 美國은 用途地域制度 決定主體가 主民이며, 計劃을 擔當하는 부서가 專問化 되어 있다. 2) 美國의 計劃은 그 內容이 詳細할 뿐 아니라 각 地域別 特性을 유지하기 위하여 地域別 親制內容을 명확히 親制하고 있다. 3) 韓國은 用途地域制度의 決定을 中央政府가 주관하고 있으며, 地域間 用途純化가 어려워 用途地域의 基本理念 推求가 되고있지 않는 상태이다.

This study is comparative study on Zoning Regulation of Korea and U.S.A., which have played the key role i n the policy of Urban Planning, On the occasion of Korea, the varity of Zoning and the right of designation is precribed by the nationwide - Urban Planning Act , and the building in each Zone is precribed by the Building Act . As a rule, on the occasion of U.S.A., committed the right of enactment. to the Local autonomous entity. So, It, is a little difficult for us to indiscriminate compare Zoning of Korea and U.S.A. so, concerning Zoning of U.S.A., we can take the case 'of Zoning in New York City , which has a pervasive influence on regxilation - enactment of other cities.

The procedure of this study, first, we look through the trannsition of the Urban Planning System that are the base of both Zoning and the purpose and the content of Building Control. Eventually, the results of this study are as follows 1) In U.S.A., making decision on Zoning depends upon the every inhabitants in the city and the post in charge of the planning were specialized. 2) The planning of U.S.A. is very detailed to keep the characteristics of each Zone, in order to definite requlations of each Zone are well prescribed, 3) In Korea, the central goverment superintend the decision of Zoning , owing to the difficulties of USE refinnent, cannot estimate the basic idea of Zoning.
