廢校財産 活用方案에 관한 法的 考察

폐교재산의 관리 실태와 효율적인 활용 방안을 검토했다.

본 연구는 농어촌 지역의 인구감소 현상에 의해 교육부의 소규모 학교 통폐합 추진으로 발생한 폐교재산의 관리에 따른 여러 가지 교육 정책의 문제점을 파악하여 앞으로 효율적이고 적극적인 폐교의 활용방안을 제시하고자 하는 데 그 목적이 있으며 이를 위해 경기도 시·군 지역의 2006년 현재 임대 활용중인 폐교를 대상으로 하여 분석하였으며, 연구를 위한 방법으로는 소규모 학교 통폐합 및 폐교재산의 활용과 관련된, 학위논문, 각종학회지, 공인된 기관의 통계자료, 교육인적자원부 내부자료(2006)와 폐교재산 활용방안 및 관리지침을 이용하였다. 또한 경기도 관내 폐교재산 활용안내사이트에서 제공하는 폐교재산 정보안내서비스를 이용하여 시·군 지역의 폐교재산 현황 등을 분석하여 폐교현황과 활용방안을 제시하였다. 현재 활용되고 있는 폐교를 활용방법별, 활용유형별 관계를 파악함으로써 보다 효율적이고 적극적인 폐교의 활용방안을 제시하여 분석한 결과는 다음과 같다. 첫째, 민간전문 부동산신탁사의 사업능력과 노하우를 최대한 활용(토지신탁) 둘째, 민간업자와 공동개발 등 사업다각화로 폐교재산의 활용증대 셋째, 제도 개선방안으로 학교용지 부담금을 폐교재산 활용을 위해 일정부분 지원금으로 보조 등 정책전환을 통하여 효율적인 관리가 필요하다.

The purpose of this study is to identify problems with the education policy in connection with use of the property of closed schools caused by Ministry of Education's drive to combine small sized schools and propose ways to utilize the properties more effectively. To this end, this study analyzed the schools in use within the cities and counties of Kyunggi province. Approaches to the study include theses, journals, statistics, internal documents of Ministry of Education(2006) and Instructions on use and management of the property of closed schools available.

The website which provides information on the closed schools within the province to analyse the current status of the use of the closed schools. The more effective and proactive ways to use the closed schools, based on the finding about the type method of their use, is as follows. First, it is necessary to make the best of civil real estate companies's business capability and know-how (Land Trusteeship).

Second, it is required that the properties of closed schools be more widely used by means of, for example, civic developers Third, poly turnaround needs to be considered to give subsidy in part in order to use the school land burden charge for utilization of the properties as part of improving systems.
