부동산공시제도의 일원화에 관한 연구

부동산 공시제도의 지적·등기 일원화 방안을 연구했다.

부동산공시제도는 제도의 이원화와 관리조직이 이원화 된 형태로 운영되고 있어 공부의 공시사항이 실제현황과 일치되지 않는 현상이 발생하고 있다. 그 결과로 국가공부로서의 공신력 저하와 국민의 불편 및 행정력의 낭비를 초래하고 있어 국민의 재산권 보호와 토지의 안정적인 거래에 많은 문제점을 야기하고 있다. 지적공부와 등기부의 불일치, 담당기관의 이원화와 등록기관의 비능률성에 따라 공시사항의 중복문제와 공부와 실제사항의 불부합을 방지하기 위하여 지적과 등기를 일원화 하는 방안을 제시하는데 이 연구의 목적이 있다. 이를 위하여 부동산공시제도의 이원화로 인해 나타나는 문제점을 분석하였으며, 선진 외국의 부동산공시제도를 통하여 일원화 방안의 기본 틀을 구축하였고 1973년부터 현재까지 정부차원에서 추진했던 통합의 논의과정을 살펴보고 논의의 주요쟁점 등을 분석하였다. 부동산공시제도의 일원화를 위하여 기본방향을 설정하였으며, 통합에 따른 제도적 혼란과 국민의 피해를 최소화하기 위하여 단기적, 장기적 측면에서 방안을 접근하였다. 부동산공시제도의 일원화 방안은 공시법령의 정비, 지적공부와 부동산등기부의 통합, 부동산공시 조직의 통합, 관리체계의 통합 등으로 구분하여 단기적, 장기적 측면에서 제시하였다. 부동산공시제도의 일원화의 필요성과 통합에 따른 논의과정과 일원화 방안에 따른 기대효과를 분석하였다.

Since a real estate public notice system has been managed separately in terms of system and organizational structure, the public notice information on the public records is not unify with the real situation. As a result of this problem the reliability of public records has been decreased, wasted an administrative resource and raised problems of protection of citizens property right and a stable land market. The purpose of this research is to present a way how to unify cadastre and registry to address the above mentioned problems.

In order to carry out the research objective a comprehensive literature review on history of discussion on the integration of cadastre and registry since 1973 has been conducted. Not only domestic cases but also some advanced counties' cadastre and registry system has been analyzed. Based on the analysis the unification way has been proposed. In the tentative proposal the basic direction on the unification between cadastre and registry presented. A long term and short term approach has been applied to prevent a chaos of introduction a new system.

For integration of a real estate public notice system, relevant law revision, integration of public records, organizational integration and administrative organizational restructuring ways have been proposed and the expected effects have been also analyzed.
