일본의 경관신고제도와 사전협의제도 분석을 통한 경관관 리체계 연구

일본의 경관 신고·허가와 사전협의 제도를 분석했다.

본 연구는 2014년 경관법 전부개정 이후 도입된 경관심의제도의 효율성을 제고하고자 국내와법체계가 유사한 일본의 경관심의제도 운영현황과 주요사례를 분석하였다. 일본은 우리나라와 마찬가지로 2004년 국가 차원의 경관법이 제정되기 이전부터 지방자치단체에서 경관관리를 위한조례를 제정하여 적극적으로 운영해왔다. 이러한 배경에서 일본은 경관에 큰 영향을 미치는 각종개발행위를 관리하기 위한 수단으로 1) 경관법에 근거한 신고⋅허가제도, 2) 각 지자체별 조례에근거한 경관사전협의제도, 3) 지자체별 여건에 따라 가변적으로 운영하는 경관어드바이저 및 컨설팅제도를 운영하고 있다. 일본은 여러 층위에서 경관관리수단을 운영함으로써 경관심의의 효율성을 높이고 경관행위 신고⋅허가제도의 합리성을 강화하였다. 특히 일본의 경관사전협의제도와어드바이저제도는 경관행위 신고절차에 앞서 진행되며, 경관심의를 위한 사전협의와 전문가 참여가 아닌 경관을 향상하기 위한 제도로 운영되는 점이 특징적이다. 국내 사전경관계획, 사전검토제도, 경관자문제도 등이 경관심의의 보조적 수단으로만 운영되는 한계를 줄이고, 실질적인 도움을 주는 제도로서의 역할과 운영방식을 마련하는데 참고할 수 있다.

In order to improve the efficiency of the landscape design review system introduced after the 2014 revision of the Landscape Act, this study analyzes the current status and major cases of the landscape design review system in Japan, which has a similar legal system to Korea. Japan, like Korea, has been actively operating its landscape management system by enacting ordinances at the local level since before the national landscape law was enacted in 2004.

Against this background, Japan operates 1) a notification and permit system based on the Landscape Act, 2) a landscape pre-consultation system based on local ordinances, and 3)a landscape advisor and consulting system that varies according to local conditions. By operating landscape management measures at multiple levels, Japan has improved the efficiency of landscape review and strengthened the rationality of the landscape activity notification and permit system.

In particular, the preliminary landscape consultation and advisory system is characterized by the fact that it is conducted prior to the landscape activity notification process and is operated as a system to improve the landscape, not as a preliminary consultation and advisor participation for landscape review. In Korea preliminary landscape planning, preliminary review system, and landscape advisory system can be used as a reference to reduce the limitations of operating only as an auxiliary means of landscape design review and prepare the role and operation method as a system that provides practical help.
