지적공부 일원화에 관한 연구

지적공부와 관련 공부의 일원화 및 지적정보 개선방안을 연구했다.

정보화 사회로 급속히 변화하면서 토지와 관련하여 다양한 정보를 요구하는 이용자의 수가 급속히 증가하고 있는 상황에서 근대적 지적제도의 창설과 함께 토지를 공시하는 제도 및 조직의 이원화와 실제 토지현황을 정확히 공시하여야 하는 지적공부의 다양화는 지적공부의 공신력을 저하시키며, 실제 토지현황과 지적공부상의 등록사항이 일치하지 않는 상황을 발생시켰으므로 본 연구에서는 지적공부 및 관련공부의 일원화에 관한 연구를 통하여 일원화된 지적공부의 모형과 지적공부와 관련한 개선방안을 제시하는데 목적이 있다. 연구방법은 우리나라의 지적제도 및 등기제도 일원화․공시제도의 일원화․부동산관련 공부 통합화 및 지적정보의 일원화와 관련한 각종 전문서적, 학술지, 간행물, 관련 법규집, 학술논문 등의 자료를 문헌을 통하여 수집하며, 지적 및 관련공부의 일원화를 위하여 필요한 자료들은 대부분 인터넷 검색(행정안전부, 국회도서관, 법제처, 대한지적공사, 국토해양부, 지적정보센터 등)을 통하여 수집하였다.

지적공부에 관한 이론적 고찰에서는 지적 및 관련공부의 개요, 지적 및 관련공부의 일원화 필요성을 살펴보았으며, 지적공부 관리현황에서는 지적 및 관련공부의 관리현황, 지적공부 관련 제도적 현황에서는 지적공부 관련 법률 및 조직체계를 살펴보고, 지적공부에 관한 문제점들을 파악하였고 지적공부의 일원화 방안에서는 지적공부 일원화를 위한 기반조성과 공부모형 및 지적공부와 관련한 개선방안을 통하여 지적공부 일원화 방안을 제시하였다. 연구결과로는 지적공부를 일원화하기 위해 우선적으로 토지의 표시사항을 등록하는 지적공부의 등록사항에 무결성이 확보되어야 한다. 지적공부를 일원화하는 과정에서 중복 또는 누락된 등록사항을 올바르게 정리하여야 하며, 이를 바탕으로 단계적으로 일원화를 추진할 수 있고 지적공부를 일원화하기 위해 관련 법률 및 조직체계를 새로이 정비하거나 개선할 필요성이 있으며, 일원화된 지적공부의 등록 및 관리는 현재 추진을 계획하고 있는 지적재조사사업과 연계하여 추진되어야 한다. 지적공부는 지적재조사사업에 의하여 새로이 취득되는 다양한 토지관련 정보를 등록할 수 있어야 하며, 오늘날의 토지관련 정보 이용자의 기대수준에 적합하도록 정보의 갱신과 제공 또한 신속하게 이루어져야 한다.

As the society has been changed to information society, the demand for the land related information has been rapidly increased. From the beginning of modern cadastral system in Korea the organizations responsible for land registry and cadastral registration has been divided and various cadastral public registre caused to decreasing the public trust. Thus this study addressed to propose integration of cadastral public registre and land related registre. The research objectives are presenting the model of integrated cadastral public registre and suggesting the improvement plan related with cadastral public registre.

In order to carry out the research objectives, a comprehensive literature review on the cadastral system, land registre system and the integration of real estate public registre as well as internet search has been perfumed. Through the literature review on cadastral public registre the necessity for integration and current situation for managing cadastral public registre has been identified. The integrated cadastral public registre model and the improvement plan has been presented. From the research the followings pointed out as a framework shall be addressed. The data integrity in the cadastral public register should be secured in priority.

Based on the error correction cadastral public register, the integration of cadastral register can be accomplished by stages. In order to implement the integration of cadastral register the related laws and regulations and organizational structure need to be re-arranged and this should be carried out the cadastral re-surveying project. The integrated cadastral register should designed in the considerations for registering various information which is obtained during the project and updating and extensions for future demand.
