주택거래신고제도의 실효성을 높이기 위한 개선방안을 연구했다.

This study attempted to investigate the plan for raising the effectiveness of the housing transaction declaration system. Second, the integration of the housing transaction declaration system and the Real Transaction Price System for Real Estate could acquire the effectiveness of the housing transaction declaration system by including the small apartment housing with the exclusive-use area of less than 60㎡, multi-family housing and tenement housing currently taking the lead in a rise of housing price in the Kangbuk district, unlike the early period when it was introduced.

Third, it is necessary to prevent the confusion of the declarant and the public servant in charge by confining the object of housing transaction declaration to the onerous contract. Accordingly, the housing acquired through auction, public auction and court decision currently subject to declaration should be excluded from the object of declaration. Fourth, it is necessary to prevent the bona-fide damage and resolve the confusion and discomfort with predictable administration by excluding the transactional contract concluded before the designation of the housing transaction declaration district.

Fifth, it is necessary to provide facility for declarants and secure the effectiveness of the housing transaction declaration system by improving the method of declaration in case one of the parties to housing transaction declares it. The results of this study will become referential materials in providing for improvements in the housing transaction declaration system and the housing transaction declaration system will contribute to improving its effectiveness by its improvement in a direction of development.
